Tavern Market.
He says we need it to be within the C-1 area and he said it should not be in the "buffer" area between the C-1
and RA areas.
So they will have to put it other places.

I am replying so you have this from me after we spoke. Added a little more on the loading space question.

• I initially said I do not know. Please see if there are some other recent plans that we have identified this. I have
thought about this a little more and thought this might be possible if it meets the design requirements for
loading spaces.That said, I am not sure that it would meet the requirement in 4.12.13 (a) since most locations
for fueling the tanks at a store like this are near the pumps which would mean that the loading space is not
"adjacent to the structure it serves" if we counted the fueling location as the loading space.

Have you had a moment to look at the other two items I previously sent?
Here are the new questions I mentioned and the other two items I previously sent.
Two new Item:
o Can their fuel loading space count toward their normal loading space requirement (4.12.13(c))?
o Is it correct that you and Ellie had told them to use the 1/200 SF of gross footprint to use for
their parking calculation?
Two other items.
1. Since you and I discussed them having a "Buffer Zone", even to the RA area of their own lot, can
Margaret ask to have screening plantings in that "Buffer Zone". In working on the Gropen project
(SDP2016-19) which was an industrial district adjacent to an NMD (I think) Ellie had stated that they
could not even plant landscaping within the buffer based on 26.5(c), though I think that might be a
current interpretation versus exact wording. The wording is somewhat different in 21.7(c) and it
includes a sentence that states "Screening shall be provided as required in section 32.7.9." Does this
mean in a C-1 zone the "buffer zone" can be disturbed in order to provide screening (whether by plants
or fencing) to the adjoining RA areas?
2. In the pre-app it was discussed that all of the improvements for the C-1 use had to be on the C-1
portion of the parcel. Margaret was considering having them place screening trees within the RA
portion of the project, fronting on Route 64 and its off ramp. Should she only have them provide
screening plantings within the C-1 portion,just like with the other improvements?

So per this section of 5.1.20
b. No storage tanks and loading facilities shall be located closer than one hundred (100)feet from any lot line.
The 100' setback would not apply to the pumps under the canopy. The loading facility is the area where the tanker is
parked and pumps gas into the storage tanks. This should be shown so as to be within that 100'shown on page 4.

Francis,
Also, in reference to 5.1.20(b), can they have the fuel pumps closer than 100' to the property line?
I'm going to comment on them showing the underground location of the tanks and for them to show the loading
area. However, I had interpreted the pumps themselves also had to be 100' away from the property line. What is the
current interpretation on this?

Francis,
In SDP2017-9 Boyd Tavern Market they are showing 500 SF of outdoor sitting area.
The parking calc only shows "convenience store" but I was wondering if they might be having some "fast
food" component to the market. I think we might need more info on what they are including in the store.
"Fast Food" no longer has a definition in Section 3.
Would you consider some level of food component to the market as fast food, like a Sheetz Made To Order
(MTO)?
If so, "Fast Food" needs an SP in C-1.
Would an SP for "Fast Food" only apply in a C-1 zone if it is a stand along "Fast Food" restaurant and not a
small component within a market/convenience store?
