STAFF REPORT
Ceasar Hackney has made application for a variance
from the minimum side yard requirements in an A-1 Agricultural
zone . The applicant is asking for a variance of 13 feet
on the west side yard to allow him to locate subject house
to within 12 feet of his property line . On the east side
yard the applicant is requesting a 9 foot variance to
enable him to locate the house to within 16 feet of his
property line . The lot is recorded with a 80 foot frontage
running back for a distance of some 570 feet .
Plans for the house have been completed by the appli -
cant with a 52 foot width . Applicant states he was under
the impression that his house was exempt from zoning
provisions since the property was purchased prior to
enactment of the zoning ordinance .
Subject property is located on U . S . 250 East at the
intersection of Three Chopt Road .
The nearest houses appear to be 45 and 50 feet from
their respective side lines . They are however on lots
with wider frontage .
