RE: Parking Determination — Rivanna Plaza SDP2008-90 Parking Study for Commercial
Kennel (Dogtopia)
Dear Mr. Greene:
This letter is an official determination in response to your request for Zoning Administrator
approval, recommended by the Planning Commission as a condition for approval, of the
proposed parking schedule for the commercial kennel use.
The parking schedule of the approved site plan for Rivanna Plaza (SDP-2008-90 "Rivanna
Plaza Final") shows 153 existing parking spaces on site. The proposed commercial kennel use
would occupy an estimated 6,800 GSF of planned retail space within "Building A", as shown on
the site plan. The parking calculation based on the approved site plan is provided below.
Parking Schedule
Retail: 5.5 parking spaces/1000 GSF
Total GSF of Retail on site: 19,029
Required Parking: 105 spaces
Daycare: 1 space/10 children + 1 space per employee
Required Daycare Parking: 47
Total Parking Provided: 153 spaces
Based on the approved site plan, there are 37 spaces allocated for the 6,800 GSF of retail
space (5.5 spaces/1000GSF) in Building A. In accordance with Zoning Code Section 4.12.6, the
proposed commercial kennel use, based on the data provided in the parking study, in this same
space would require 22 parking spaces.
Commercial Kennel: 1 parking space/400 GSF including runs, plus one space/employee
Required Spaces for 6,800 GSF of commercial kennel space: 22 parking spaces
Because the proposed "commercial kennel" use and "retail" have different parking calculations,
the request being made is to confirm that the site, as built according to the approved site plan,
will have sufficient parking given the change of use. Based on the relevant information

presented above and in accordance with Section 4.12.6 of the Zoning Ordinance, it is my
official determination that the Rivanna Plaza shopping center, as shown on the approved
site plan, will have adequate parking for the proposed commercial kennel use.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this
determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and
the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a
fee of $258 plus the actual cost of advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia
22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of
the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
Regulations pertaining to the filing of an appeal to the Board of Zoning Appeals are located in
Chapter 18, Section 34.3 of the Zoning Ordinance. They may be reviewed online at
