Variance
Applicant is requesting a variance from the side yard
requirements in a R-1 Residential District as found under
Article 3-5-1 . The petition is for a variance of 1 . 1 feet
from the minimum side yard as required in a R-1 zone . The
need for the variance was brought about by the intrusion of
a chimney into the required side yard . The staff notes that
this building has been constructed in violation of the
requirements . The applicant is making the application to
clear the title on the subject property .
