Dear Mr. Goldsmith:
I am enclosing receipts from Mr. Bell, Dr. Flynn and Mrs. George-
anna Wright to the notices sent to them on November llth, copies of
which were furnished to your office.
The Postmaster was unable to obtain a receipt from Mr. and Mrs.
Lewis Burkett, Jr. to either my letter of November llth or subse-
quent letter of November 24th, and I enclose the original envelope
returned "no response" . Mr. and Mrs. Burkett ' s address was obtained
from the County Assessor ' s Office. Please call me if this does not
satisfy the requirements of the ordinance.

Application for a variance or special
exception
Dear Mr. Amato:
The Circuit Court of Albemarle county reversed the
decision of the Board of Zoning Appeals in its interpretation
of the Ordinance as to what constitutes a rear or side line.
Mr. and Mrs. Wade would therefore like to proceed
with a hearing on their application for a variance or special
exception which was continued generally from the Board' s last
regular meeting of December 14th.
If a special meeting is called to consider this
matter, it is respectfully requested that every effort be made
to have the full Board present. We will adjust our schedule
to suit the pleasure of the Board.

Re : VA- 71 -15 and VA-71 -24
Dear Richard :
I nave just checked with Charlie Haugh , Commonwealth Attorney ,
on the matter that came before us last week . Mr. William A.
Perkins , Jr. has filed a petttion in the Circuit Court of
Altemarle County on behalf of Henry H . Bell and Verlease Bell ,
ashing that the Court review the decision of the Board of
Zoning Appeals concerning their decision on VA-71 -15 in favor
of your clients , Randolph D. and Vivian W . wade . As you know ,
this action by the Board was to overturn the decision of the
Zoning Administrator in his interpretation of the setback require-
ments in an R-3 Residential Zone .
Since this Subpoena in Chancery has been served on the Board ,
this office will have to withhold any hearing on this matter from
the Board of Zoning Appeals until such time as the Circuit Court
Judge , the Honorable David F . Berry , makes a decision on this
matter. Until we know how the judge will rule on this the Board
cannot possible make a decision on VA-71 -24 .
