Dear Dr. Hurt :
It has come to the attention of this office that construction
is continuing on the above referenced lot in spite of the fact
that the structure was found to be in violation of the setback re-
quirements as set forth in the Albemarle County Zoning Ordinance ,
You dare hereby notified to cease and desist all construction on
the subject site until which time a Variance is granted by the
Board of Zoning Appeals . I call your attention to a copy of your
Building Permit # 73-48 which clearly depicts the yard requirements ,
signed and certified by your authorized agent .
In researching the files and reviewing your Variance application
today we find that your description of the property as submitted on
the application is incorrect and was advertised as submitted, i.e . ,
County Tax Map 61M, Parcel 2-1-A, while the correct description is
Map 61M, Lot 1-A, Block 2 , Section 1 .
Your attention again is called to the copy of your building
permit . Due to this error , it is my opinion that a correct appli-
cation must be filed, readvertised for the Board's June meeting
and a fee of $20 . 00 filed. The deadline for filing is May 14 to
be heard June 12 , 1973.
