Applicant Signature Address Phone Number ACTION BY THE BOARD OF ZONING APPEALS DATE APPROVED DENIED 150 BOARD OF ZONING APPEALS May 8, 1973 The Albemarle County Board of Zoning Appeals held its regular meeting on May 8 , 1973 , at 5 : 30 P .M. in the Board Room of the County Office Building . • Members present were Judge Amato , Chairman , Mrssrs E. H. Bain, W. P. Heath , & Harry Brown. MR. Roudabush being absent . There being a quourm present , the Chairman called the meeting to order at 5 : 35 . On motion of Mr. Brown seconded by Mr. Heath the approval of the April 10th minutes was deferred ; the minutes of the May 1 special meeting were approved as submitted. 1 . VA-73-12 . William H . Grimm and Samuel B . Wells . Applicants are requesting the Board of Zoning Appeals to grant a variance from the minimum side yard requirement of 25 feet in an A-1 Agricultural zone . Applicants request a variance of 7 ' 8" on south side & 5 '4" on north side . Property is described as County Tax Map 44 , Parcel 36-A, containing . 43 acres . Jack Jouett Magisterial District . Judge Amato announced that the subject application had been an agenda item for the April meeting ; that it was discovered that there was an error in the application which made it necessary that the applicant submit a corrected application and advertise again. Mr . Wells appeared before the Board stating that he had submitted a corrected application which was advertised as requesting a variance of 7 ' 8" on the south side & 5 '4" on the north. MR. Wells showed a new survey. No one appeared in favor of or in opposition . The Chairman announced the public hearing closed . On motion of Mr. Bain , seconded by Mr . Brown the Board unanimously granted the Variance . 3. VA-73-06 , William H. Grimm and Samuel B. Wells . Applicants are requesting the Board of Zoning Appeals to grant a variance from the minimum side yard requirement of 25 feet in an A-1 Agricultural zone . Applicants request a variance of 3 ' on the north side and 4 ' on the south side . Property is described as County Tax Map 44 , Parcel 36 A, containing . 43 acres . Jack Jouett Magisterial District . Mr . Humphrey stated the subject lot is located on Route 657 . Mr. Wells appeared before the Board stating that after the house in question was under construction it was found to be encroaching on the side yards requirement of 25 ' ; that after the variance application was submitted a survey revealed, that the encroachment was greater than stated in the • -6- application ; that the builder thought the side line requirement wat 10 ' ; that there were no complaints , they just stopped construction because they knew they were in violation. On question of Judge Amato , Mr . Humphrey stated that in his opinion , if the application was advertised for less than is actually needed, the application will have to be readvertised . Mr. Wells stated that after the survey they found they need 7 ' 4" on one side and 5 ' 4" on the other ; that it was advertised for 3 ' on the north side and 4 ' on the south side . On question of Mr . Roudabush , Mr . Wells stated that the lot has vacant land on both sides owned by Dr. J. A. Jackson . On further question of Mr. Roudabush, Mr. Humphrey stated that Dr . J. A. Jackson was notified and no objections were received . After further discussion it was agreed the application would have to be readvertised. Judge Amato suggested that Mr . Wells get in touch with the Zoning Administrator for a possible special meeting . On motion of Mr. Brown, seconded by Mr . Roudabush , the application was unanimously withdrawn without prejudice . *sr Nose APPLICANT'S LIST OF ADJACENT OR ABUTTING PROPERTY OWNERS The Planning Department will list all Map and Parcel Numbers of Adjacent or Abutting Property Owners. Applicant is to then take this form to the Real Estate Office where personnel in that office will aid applicant in listing property owners and addresses of all Map and Parcel Numbers given below.
