Members present were Judge Amato , Chairman , Messrs W. P. Heath, Harry Brown, and William Roudabush. Mr. Bain being absent . There being a quorum present , the Chairman called the meeting to order at 5 : 40. Judge Amato , Chairman, announced that since this was a special meeting , the minutes of the Board' s April 10 , 1973 , meeting would not be considered. VA-73-08 . The Robert L. Barretts request the Board of Zoning Appeals to grant a special exception to allow horses in an R-2 Residential zone on property described as County Tax Map 56C, Block C, Lot 1 , containing 2 . 15 acres . White Hall Magisterial District . Judge Amato stated that the subject application had been deferred from the Boards April 10th. meeting in order to obtain an opinion from the County Attorney; that all evidence in the matter was heard at the April 10th. meeting ; that an opinion of the County Attorney has been received and the question before the Board is whether or not to grant the subject application based on Section 12 -6 of the Zoning Ordinance which he read. Judge Amato stated that , in his opinion , no evidence has been sub- mitted to indicate the following . (1) that the health , safety and wel- fare of the occupants of adjoining and surrounding property will be adversely affected; (2) that the granting of the Special Exception will impair an adequate supply of light and air to adjacent property; (3) that there will be an increased congestion in the public streets nor danger of fire or other hazards ; . (4) that the intended use will tend to 149 .2. diminish or impair established property values in surrounding areas . Mr. Barrett showed a plat of his property and indicated 'where the proposed stable was to locate . On question of Judge Amato , Mr. Barrett stated he planned to reces the stable into the hill which would help to screen it ; that it could not be seen from any other lot in the subdivision; that the stable is to be 1 1/2 stories , A shape ; that he plans to store hay in the top story. On question of Mr. Roudabush, Mr . Barrett stated that the stable will be located approximately 200 ' from all property lines . Mr . Roudabush moved that the Special Exception be granted with the following conditions : 1 . The stable be located no closer than 100 ' to any property line . 2 . The Special Exception not run with the land but runs with the applicant , and any future user be considered as a new application. 3. The stable be built with an A roof. The motion was seconded by Mr. Brown and passed unanimously by members present . There being no further business to come before the Board the meeting adjourned at 5 : 50 . Ruth Miller Zoning Administrator Albemarle County Office Building Charlottesville, Virginia 22901 Dear Mrs. Miller: This is in response to your inquiry to me on April 23, 1973 , in your office, concerning a matter designated VA-73-08 in the minutes of the April 10, 1973 , meeting of the Albemarle County Board of Zoning Appeals . This was an application for special exception to allow horses in an R-2 residential zone, by Robert L. Barrett. This opinion is based on the assumption that the chairman of the Board of Zoning Appeals has posed a question as to whether the granting of this special exception would consti- tute legislation, i.e. , a change in the zoning ordinance; and an additional question related to the first, that is, whether or not a special exception is the same as a "special use permit" under the zoning ordinance and therefore a matter which should properly be brought before the Planning Commission and Board of Supervisors as an application for a change in the zoning map and subsequent application for a special use permit, rather than this application for a special exception to the Board of Zoning Appeals . After examining the appropriate State statute, which is Code Section 15 .1-495 (c) , and the County ordinance which is Section 12-6 of the Zoning ordinance, my opinion is as follows: A. The granting of this application for special exception would not constitute legislation by the Board of Zoning Appeals, nor would it constitute a re-zoning as prohibited by the State statute. In other words, the granting or denial of this application is within the discretion of the Board of Zoning Appeals, and in fact . vNIY po aAiLeEMq W. Office of County Attorney GEORGE R. Ruth Miller Page 2 April 23 , 1973 it is the duty of the Board of Zoning Appeals either to grant or deny it on its merits, using the guidelines as set out in the State statute and County ordinance, rather than to simply refuse to entertain it on the grounds that it would constitute legi- slation or a change in the zoning map. B. The provisions in the zoning ordinance and the State statutes, with respect to the special use permit authorized under the various different zoning districts, and which are applied by the Planning Commission and the Board of Supervisors rather than the Board of Zoning Appeals, constitute a completely separate pro- cedure with different standards, from the application for a special exception to the Board of Zoning Appeals . It is true that the applicant in this case might well have chosen to apply for a change in zoning to R-1 and then immediately apply for a special use permit if he were granted the necessary change in zoning; however, the special use permit provisions do not pre- clude him from choosing an alternative route for relief, the special exception, which he has done here. As a matter of fact, it would appear to me that the application for special exception more nearly fits the situation here, because were he to apply for re-zoning to an R-1 zone and then immediately apply for a special use permit, he would be asking for "spot zoning" which is to be avoided, whereas the standards for allowing or denying a special exception in this case seem to me to be more flexible. In other words, to reiterate, I believe the Board of Zoning Appeals is obligated to take jurisdiction of this application and either deny it or grant it on its merits . Ruth Miller Page 3 April 23, 1973 the two alternative applications which a landowner may utilize before the Board of Zoning Appeals in a case of this kind. As I pointed out to you, the two are not the same in any respect and the standards for granting a variance are very different from those for granting a special exception. This question did not arise in the Barrett matter, but I feel it should be clarified at this time. I am sending a copy of this letter to the Hon. Savory E. Amato along with the assurance that I certainly do not want this letter to be interpreted as my favoring either granting or denial of the application; it is simply that I feel the appli- cant has selected the proper, if not the only, forum and I feel his application should therefore be decided on its merits . On question of Mr . Roudabush, Mr . Barrett stated the lot consists of 2 . 15 acres . On further question of Mr . Roudabush , Mr. Humphrey stated that the sub- division was placed in an R-2 zone at the time the original map was adopted to protect it from obnoxious agricultural uses . Judge Amato observed that when he first read the application he was of the opinion that the Board would be legislating in acting on the applicati and that a special exception under a special use permit for such a use is permitted in R-1 and RS-1 zones but not in the R-2 zone. Mr. Barrett stated that his property borders the McCauley land where he kept horses for many years ; that Mr . McCauley had promised to sell him some land but he died in January 1973 ; that Mr . Pickford , former County Attorney , had advised him to apply for a special exception ; that none of his neighbors objected ; that the subdivision is bounded by A-1 . Judge Amato reiterated his question as to whether or not the Board would be legislating if they granted the exception. After a lengthy discussion concerning special exceptions versus variances , special permits and use permits , the Board took the following action: On motion of Mr . Roudabush , seconded by Mr . Mr. Humphrey stated that the subject property is located in a sub- division with frontage on a 50 ' road off Route 240 just south of Crozet , near the Crozet cemetery; that all neighboring property owners were notified. On question of Judge Amato , Mr . Humphrey stated that he questioned accepting the subject application because , although there is a provision for special exceptions in the zoning ordinance , there are no guidelines except under individual zones ; that there is section 12-6 called Special Exception which is very ambiguous ; that stabling for light horses ( and ponies is permitted in R-1 & RS-1 zones with a special permit ; R-2 does not include this use .
