County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any VSMP permit by issuing a project approval or denial. This project is denied. The rationale is given in the comments below. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. The SWPPP was not found with this submittal. A SWPPP for this type of project is required in accord with 9VAC25-870-30. The project is not exempted by 62.1-44.15:34 of the Code of Virginia. The design consultant is to provide a SWPPP using the standard template from the County website. Revision I Response: SWPPP provided with this submittal. Revision I Comment: SWPPP submitted our comments as follows: A. Please add WP0201800027 to the cover sheet of the SWPPP and stormwater management calculations package. B. SWPPP Section 2 —Please provide a copy of the DEQ coverage letter when obtained and place in the SWPPP. C. SWPPP Section 4 —Please provide a copy of the approved Erosion and Sediment Control Plan when obtained and place in the SWPPP. D. SWPPP Section 6: i. Paragraph C — Concrete washout and cement waste not shown on PPP as stated. Please provide location on 11 "x 17"PPP exhibit. ii. Paragraph F— The Crozet Fire Department and phone number has been listed. We recommend a closer fire station and phone number be listed. Engineering Review Comments Page 2 of 6 E. SWPPP Section 7 — The discharge is noted to be to impaired waters. Please add verbiagefrom 9 VA C25-880- 70, Part (B)(4) (b), (c), and (d)1. F. Section 9 — Please execute the certification. G. Section 10 —Please execute the Delegation of Authority certificate. Revision 2 Response: The SWPPP was revised with this submittal. Revision 2 Comment: A complete SWPPP was not found with the submittal package. Only the DEQ Registration Statement and Section 3 narrative were included. Please provide a complete SWPPP addressing the above comments. B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. The PPP exhibit will need to be included in the SWPPP. The design consultant is to provide a PPP exhibit using the standard template from the County website. Revision I Response: PPP exhibit included in the SWPPP. Revision I Comment: See Comment ID above. Revision 2 Response: The PPP exhibit was revised with this submittal. Revision 2 Comment: The PPP exhibit was not found with the submittal package. Only the DEQ Registration Statement and Section 3 narrative were included. Please provide a PPP exhibit addressing the above comments. Per 9VAC25-880-70 Part III(K), the VSMP Registration Statement is to be signed by the property owner, Martha Jefferson Hospital, and not by the contract purchaser, Riverbend Development. Revision I Response: VSMP Registration Statement will be submitted with Owner signature. Revision I Comment: Comment acknowledged. Revision 2 Response: It is acknowledged that the VSMP Registration Statement will need to be submitted with the owner's signature. Revision 2 Comment: Comment acknowledged. C. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is disapproved, and the reasons are provided in the comments below. The stormwater management plan content requirements can be found in County Code section 17-403. The activities associated with this project meet the definition of "Development" as contained in 9VAC25-870-10 and are not "Exclusions" per 9VAC25-870-300. Thus, stormwater management quantity and quality controls are to be provided. Please provide quantity and quality controls per 9VAC25-870 and provide appropriate details, calculations, etc. demonstrating compliance. Revision 1 Response: The plan has been revised to include a stormwater management plan. This plan provides both water quantity and quality controls per 9VAC25-870. The plan also provides details, profiles, and an extensive calculations packet showing stormwater compliance for the ultimate development of this project. Revision 1 Comment: Comment addressed. Requested information provided. Please note that additional comments may be generated based on responses to these comments. Revision I Response: Comment acknowledged. Revision I Comment: Our additional comments are as follows: A. Please add WPO201800027 to the calculations booklet as well as the Engineer's seal signed and dated. Revision 2 Response: The WPO number and a PE's seal have been added to the calculations packet's cover sheet. Engineering Review Comments Page 3 of 6 Revision 2 Comment: A signed PE's seal was not found on the calculations packet's cover sheet. Please provide a signed and dated professional engineers seal on the cover sheet of the calculation packet. B. The southernmost portion of the emergency spillway is in fill rather than cut. The portion of the spillway in fill needs to be armored or spillway moved/SWM regraded such that the entire spillway is in cut. Revision 2 Response: The wet pond's emergency spillway, which is located in fill, has been revised and is now armored with riprap. Please see sheet 7 in the upper - right corner for details. Revision 2 Comment: Comment addressed. C. Please verify that principal spillway riser is in weir control through the 100 year storm. If not, please provide anti -vortex device. Revision 2 Response: A note and detail have been added to sheet 6 in the lower -right corner requiring the contractor to install an anti -vortex device on the SWM facility risers. Revision 2 Comment: Comment addressed. D. We recommend that means to drain the facility be provided. Revision 2 Response: A sluice gate valve has been added to the wet pond's riser. The sluice gate valve is located at the bottom of the wet pond and the valve's handle will be positioned near the riser's rim, inside the riser. Please see sheet 7's profile entitled `Wet Pond Section' for notes requiring this installation. Revision 2 Comment: Comment addressed. E. Please provide a calculation demonstrating a 3L:1 Wflow path. Revision 2 Response: Sheet 7 has been revised in the bottom -right corner to include dimensions of the wet pond's overall length (226') and width (48') at the riser/mean water surface interface. The revised pond achieves the minimum 3:1 Length/Width ratio requirement set forth in Table 14.3 of Virginia DEQ's specification No. 14 dated January 2013. In accordance with a phone conversation with Mr. John Burn of WW Associates this was deemed an acceptable resolution to this comment and that the flow path itself did not need to be dimensioned. Revision 2 Comment: Comment addressed. F. A safety bench is required as the pool depth of 6' is greater than 4'. Revision 2 Response: The pond has been revised to have a pool depth of 4'. In addition to this, the pond has been revised to include more gentle side slopes. The plans no longer propose 3:1 slopes and now propose more gentle 5:1 slopes. In accordance with the Virginia DEQ specification No. 14 dated January 2013, under the section 6.3 entitled `Internal Design Geometry' on sheet 10, "A safety bench is not necessary if the stormwater pond side slopes above the permanent pool are 5H. I V or flatter." In the aforementioned phone conversation with Mr. Burn of WW Associates this was deemed an acceptable method for addressing this comment. Revision 2 Comment: Comment addressed. G. The outfall riser is not accessible from the bank. The outfall structure is to be accessible without the need to drain the facility or enter into the facility. Revision 2 Response: The wet pond has been revised to have more gently sloped grades. The pond no longer has 3:1 side slopes and now has more navigable 5:1 slopes consistent with minimum Virginia DEQ specification No. 14 requirements. Additionally, a level graded access is provided/shaded on sheet 7 running from the top of the dam down to the basin's floor near the riser. Revision 2 Comment: Comment addressed. Engineering Review Comments Page 4 of 6 D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is approved. The erosion control plan content requirements can be found in County Code section 17-402. The VSMP Application for Albemarle County is signed by the contract purchaser and not the property owner. Please refile applications with the signature of the proper Martha Jefferson Hospital authorized person. Revision I Response: VSMP Application will be refiled at the County with Owner signature. Revision I Comment: Acknowledged. Revision 2 Response: It is acknowledged that the VSMP Application will be refiled at the County with the owner's signature. Revision 2 Response: Acknowledged. The professional engineer's seal is to be signed and dated on all plan sheets, SWPPP cover sheet, and any design calculations submittals. Revision I Response: Comment acknowledged. Final plans and calculations will be signed and dated. Revision I Comment: Acknowledged. Revision 2 Response: The revised plans and calculations have been signed and sealed. Revision 2 Comment: A signed seal was not found on the plans and calculations. Please provide a signed and dated professional engineer's seal on the plans and calculations. Please show the limits of the inundation zone on the plans. Revision I Response: Limits of inundation zone shown and labeled on the plans. Revision I Comment: Comment addressed. 5. Please remove the `Existing Rivanna River" label from the unnamed tributary on Sheet Nos. 2 and 4 (below the boundary course S82°18'56.00"W). The FEMA FIRM referenced (51003C0145D) on the cover sheet is inaccurate. The correct reference is 51003CO289D as shown on Note No. 1 in the upper right hand corner of Sheet No. 2, As based on our inspection of the correct FIRM reference, parcel 07800-00-00-020M3 is in Zone X "Area of Minimal Flood Hazard." Please annotate plan cover sheet stream buffers/floodplain note and Note No. 1 on Sheet No. 2 accordingly. Revision I Response: FEMA reference number has been revised on the plans. Revision I Comment: Comment addressed. 7. Please provide location of dust control symbol on Plan Sheet No. 4. Revision I Response: Dust control symbol provided on Sheet No. 4. Revision I Comment: Comment addressed. 8. Please provide buoyancy/anti-floatation calculations and size the riser anchor accordingly. Revision I Response: Riser anchor provided. The minimum 2x riser diameter length/width requirementfor riser anchors has been provided (48" riser, L=8', W=8', D=15 ). This anchor weight (approximately 14,400 lbs) is in excess of the buoyancy force created by the riser (approximately 7,312 lbs). Revision I Comment: Comment addressed. Revision I Comment: Comment addressed. 10. Silt fence along the southern property line cross contours. Please place silt fence parallel to contour by using tangents. Please add symbol for managed and preserved slopes to the legend. Revision I Response: Managed and preserved slopes have been added to the legend. Revision I Comment: Comment addressed. The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process: After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Please coordinate Nutrient Credit Purchase with the County's Management Analyst prior to purchase. Evidence of purchase of required level of nutrient credits is required prior to Applicant receiving a grading permit. Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. After bonding (and nutrient purchase, ideally) and agreements are complete, county staff will need to enter project information in a DEQ database for state application processing. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that work may begin.
