Albemarle Board of Zoning Appeals County of Albemarle Charlottesville, VA 22901 Re: Statement of Justification Salem Carpet Mills, Inc. Application for Variance Gentlemen: We offer the following facts in support of our appli- cation for variance. The Albemarle County Zoning Board issued a building permit to Salem Carpet Mills , Inc. in March, 1973 after Salem agreed to give up seven feet on the east side to save some trees located alongside the building. The building permit was granted on site plans furnished by Roudabush and Gloeckner, which are enclosed with the application as an exhibit . At the same time the building permit was granted, Salem Carpet Mills, Inc. ordered the building. Subsequently, as an afterthought, a canopy was added to shelter customers from inclement weather. Due to an oversight on the part of the management this small change was not relayed to the Zoning Board. Upon completion of construction in August, 1973 , and when members of the Zoning Board were reviewing plans for construction of a sign, the setback violation was pointed out to the management. Salem Carpet Mills, Inc. complied with the request of the Zoning Board regarding the sign and has not placed a sign at the entrance to its building. However, the canopy still stands, extending 4.5 feet from the building, said building being set back 30 feet from Route 250 East. It would cause extreme hardship for Salem Carpets, Inc. to remove it since the steel girders supporting the canopy are imbedded in the building structure itself and the cost of such removal would approximate $5 ,000.00--$7 ,000.00. Therefore, we appeal to the Albemarle County Board of Zoning Appeals to grant a variance for the canopy which we Albemarle Board of Zoning Appeals October 15 , 1973 Page two consider to be an attractive and necessary part of the building. The sole reason that the Board was not notified of the change was because of an oversight on the part of the management. We therefore appeal for a variance on hardship grounds .
