Menbers present were Judge Savory Amato , Chairman , Messrs William Roudabush, E . H. Bain, W. P. Heath; Mr . Harry Brown being absent . There being a quorum present, the Chairman called the meeting to order at 5 : 35 p.m. The Chairman announced that consideration of the minutes of August 14th. would be taken up at the end of the meeting . 1 . VA-73-23 , H . J. Browne , applicant requests the Board of Zoning Appeals of Albemarle County to grant a 7 ' variance from the 50 ' front setback requirement in an RS-1 residential zone . Property is known as "The Pines " and situated North of Route 764 at its intersection with Route 663 and is described as County Tax Map 31 Parcel 4 , Lot 17 , Block A, Rivanna Magisterial District. The Secretary read the applicants statement of justification, a copy of which is in the applicants file . Mr . Brown appeared before the Board. Mr . Brown described the location of the property in question, stating that his crew was so intent on preserving trees that the error was not caught until the site survey was made; that the house was located right at the 50 ' setback line except at the point of a curve in the road which had not been allowed for in placing the house on the lot which caused that corner of the house to be 7 ' into the required 50 ' setback; that he had dedicated 25 ' to the Highway Department. The Secretary stated that her secretary had given her a telephone message from Mrs . Arlene Kyger , an adjoining property owner, expressing concern for future widening of Route 764 . No persons appeared in favor of or in opposition to the application �.. -2- �.. On motion of Mr. Bain seconded by Mr . Heath the Board members present unanimously granted the Variance . On motion of Mr . Roudabush seconded by Mr . Heath the minutes of August 14 , 1973 , were unanimously approved subject to correction of the spelling of the word"decelerate" . Humphrey Albemarle County Planner County Building Charlottesville, Virginia Dear Mr. Humphrey: We are requesting a variance from the current building ordinance covering setback requirements to facilitate an addition to an existing structure. The Crozet plant was constructed prior to the existance of the building ordinance now in force. A major portion of this plant is in violation of the current setback regulations. At least two other points of the plant are the same distance from the right of way as is this proposed addition. The proposed addition is essential for housing a continuous freezing unit for one of our main line products now in production at this plant. The new equipment is of such size and configuration that no location within the existing structure can accommodate it. The installation of this equip- ment is critical to our economic health.
