Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two fees for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications reviewed by the Board of Zoning Appeals,however,only require one public hearing and therefore require just one fee for public notice. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between$400 and$450 per hearing. Said tenant space is located within the Retail development known as The Shops at Stonefield. The physical address is 2015 Bond Street, Suite 110, Charlottesville, VA 22901. The property has frontage on both Seminole Trail (SR-29) and Bond Street and requires a Special Use Permit for outdoor display within an Entrance Corridor. Outdoor display area is an essential component of LL Bean's branding identity and is standard throughout the Country. The elevation on the existing Blue Ridge Mountain Sports tenant space for which we are proposing (2) exterior Kayak display areas will be located on the S side of the building fronting Seminole Trail (SR-29); which consists of 2,340 total square feet of wall area. The two small proposed Kayak display areas will only measure 60 square feet each (120sf total) and is correct in proportion as related to said elevations architecturally. The Special Use will not have any negative impact on any adjacent properties. Instead, LL Bean promotes environmental sustainability through reuse of an existing commercial building, successful reuse of a commercial site with no associated site work. The proposal is consistent with the uses intended within the Neighborhood Model District.
