Box 5526 • CHARLOTTESVILLE,VIRGINIA 22903 • (804) 296-4141 July 17, 1973 Mrs. Ruth Miller Zoning Administrator County Office Building Charlottesville, Virginia 22902 Dear Mrs. Miller: Following my discussion with you on Wedensday of last week, I have enclosed herewith a copy of our final in place survey for Westgate Phase II along with Certificate of Occupancy requests for two buildings. Please note that Building 12 BC at the north end of the property has an 18' setback on one end. As I believe this would be considered a back yard, we are short 7' . This was caused by a mistake in the original survey which was not discovered until Buildings 15A, 12 BC and 13 C were laid out. Our northern property line is actually the location of an 8" water main we installed and turned over to the Albemarle Service Authority. I don't know how or why the original mistake was made. We also own Parcel D shown on the final survey. I spoke with Mary joy White about this and she suggested two alternatives. The first would be to deed enough property from Parcel D to satisfy the set-back requirement or, as a second alternative request a variance from the Board of Zoning Appeals. Although we could deed a small piece of property from Parcel D to clear up this problem, we would prefer to request the variance as a transfer of property would involve ourselves, a lessor, a sub- lessor, and two mortgage companies located in separate states. As Parcel D also belongs to us, we would agree, in writing, to increase our set-back for any improvements to that parcel by 7' at the point near Building 12 BC.
