Date 3/28/73 The petitioner requests that the Zoning Administrator grant: A variance or special exception to the 2 acres regnirPment for these lots, and allow the lots to remain as they are. The plats were recorded many months ago, in 1972, and 8 lots have houses on them, and the other 4 are under construction. The applicant_makes this request because: He has no other land to add to the lots. The error was made by W. F. Wade, the Surveyor, upon whom Mr. Davis , the subdivider, relied. Mr. Wade erroneously included in his 2-acre calculation that part of the lot which extends from the margin of the road to the center thereof. Wilson Davis , applicant requests the Board of Zoning Appeals of Albemarle County to grant a variance from 2 acre minimum requirement on 12 lots which were recorded in error on property described as County Tax Map 45 , Parcel 50- 1 ,2 ,3 ,4 ,5 ,6 , 7 ,8 ,9 ,1.0, 11 ,12 , Rivanna Magisterial District . Judge Amato announced that he disqualified himself from partici- pating in the subject application since Mr. Davis sells some property through Real Estate III with whom he is associated and requested Mr. Bain to chair the hearing. Mr. Orbin Carter, attorney representing Mr. Davis , appeared before the Board. Mr. Carter stated that the 12 lots in question had been recorded last year; that most of the lots were built upon and sold; that when they had the lots checked by another surveyor the 12 lots were found to be short of 2 acres ; that 1 lot had been re-surveyed by Mr. Roudabush and found to be about 1/10th of an acre short of 2 acres ; that it would work a terrible hardship on the purchasers of the lots ; that there is ( no adjacent land available ; that the original surveyor had erroneously calculated the total square footage to the center of the road; that there is a technical problem in clearing the title . On question of Mr. Bain, Mr. Carter stated that in order to be specific on each lot a new survey would be needed for which there are no funds ; that they are only sure of the one lot being 1/10th short of 2 acres ; that to the naked eye the lots appear to be correct . Mr. Wilbur Clarkson property owner across the road from the subject lots appeared before the Board. On question of Mr. Clarkson , Mr. Carter showed a copy of the recorded plat on which Mr. Humphrey had shown in red the area of each lot which was in error ; that the plat was recorded whowing each lot as containing 2 acres and the total acreage as 24 ; that due to the error, the total acreage is 23 with each lot being a little short of 2 acres . Mr. Carter stated that lot #7 had been resurveyed by Mr . Roudabush 152 -3- at which time the error was discovered; that the original plat had been recorded on July 18 , 1972 . I/ On question of Mr . Clarkson , Mr. Carter stated that in order to know the exact shortage each lot would have to be resurveyed and it is his opinion that the difference would not be enough to upset him; that there would not be a shortage of as much as 1/2 acre on any lot . Mrs . Leslie Hawkins , neighboring property owner, asked that if in the future the Highway Department continues to take 10 ' to 18 ' for improvement how will the lots in question be affected . Judge Amato , speaking to the question, stated that if the Department of Highways condems a protion of a 2 acre lot for road improvement , making the lot less than the required 2 acres there is no violation of the law. No other persons appeared in favor of or in opposition to the application. The acting chairman announced the public hearing closed . On motion of Mr . Brown, seconded by Mr . Heath the Board with a concurring vote of 3 granted the Variance request , Judge Amato having disqualified himself .
