May 20 , 1970 Page 42 APRIL 14 , 1970 This was a regular meeting of the Albemarle County Board of Zoning Appeals held on April 14 , 1970 at 5 : 30 P .M. in the Board of Supervisors meeting room with the following members present : Judge Savory E . Amato , Chairman ; Herbert Pickford , Vice-Chairman ; Harry Brown , W . P . Heath , and E . H . Bain . The Chairman established that a quorum was present . The minutes of February 24 , and March 10 , 1970 were approved as submitted . The Chairman called for the appeal hearing of J . Robert Henderson . 1 . Appeal of Administrative Decision . J . Robert Henderson . Applicant has petitioned the Albemarle County Board of Zoning Appeals for an appeal from the Zoning Administrator ' s decision regarding maximum dwelling units permitted in a R-3 Residential Zoning District as presented under Article 5 of the Albemarle County Zoning Ordinance . The staff presented the basis of his decision regarding density computations and an analysis of the R-3 zone by Mr. Rosser Payne , Consultant . Mr. Henderson , petitioner , presented his case expounding on the basis of his interpretation as to density permitted . A general discussion followed , after which Mr . Pickford made the following motion seconded by Mr . Bain that the Zoning Administrator' s decision regarding density permitted under the R-3 zoning category be upheld . The motion carried by a 5 to 0 vote . Mr. Pickford stated that Mr. Payne ' s analysis was the basis for his decision . At this time the Chairman called for the public hearing relating to a request for a variance . 2 . Variance . Charlottesville Towne Houses . Applicant has petitioned for a 13 foot variance from the r required 25 foot rear yard requirements and a 19 foot variance from the required 30 feet for front yard setback , as found under Article 5-3-1 and Page 43 5-5-2 of the County Zoning Ordinance in a R-3 Residential zone . Charlottesville Magisterial District , "Westfield Subdivison" . The secretary presented request which was elaborated on by Mr. Morris Foster , representing Charlottesville Towne Houses . The hardship presented was the fact that the County is requiring an open reserved area to be utilized by a proposed road which prevents the applicant from locating the building so as to not require a variance . After a discussion , Mr . Heath made the following motion seconded by Mr . Brown that the variance as requested be granted . The motion carried unanimously . The Board , in granting the variance , noted that a hardship did exist by virtue of the County requiring a reserved area which necessitates arrangements of buildings causing an intrusion into the required front and rear yards .
