R. 0 . and Victoria Burton Map 32C , Lot 5 Existing Zoning : R-1 Residential Location : Lot is located on Deerwood Drive just north of its intersection with Lupine Lane , off of Route 649 adjacent to the Albemarle-Charlottesville Airport. Character of Area : Dwellings exist on Lots 4 , 5 and 6 . The house on Lot 5 which belongs to B . G . Harwell is a moderate size brick home . Block 2 and Block 5 across from this area are as of yet undeveloped . Staff Comment : The County Planner has recommended denial of this request . It is Mr . Humphrey ' s opinion that too much irresponsibility in construction is taking place in the County . It should be noted that the building permit showed a distance of 30 feet for the setback . The staff would make reference to the number of mobile homes that were in violation at last nights Planning Commission meeting . It should be noted also that approxi - mately ten ( 10) building permits have been issued during the past month for dwellings or accessory uses that were already under construction . Reference is made to Article 12-2-3 of the County Zoning Ordinance as it pertains to hardships . The staff can determine no hardship existing in the case of the Burton request . Nge 55 December 8, 1970 • This was a regular meeting of the Albemarle County Board of Zoning Appeals held on Tuesday, December 8, 1970, at 5:30 P.M. in the Board of Supervisors meeting room with the following members present: Savory Amato, Chairman; Herbert Pickford, Vice-Chairman; and Mr. W. P. Heath. The Chairman established that a quorum was present. The minutes of the November 10, 1970, meeting were approved as sub- mitted. A. Special Exception. Boar's Head Sports Club. Applicant has petitioned the Albemarle County Board of Zoning Appeals for a special exception to permit the construction of related facilities pertaining to the proposed paddle tennis courts, over the property line connecting the properties of the Boar's Head Sports Club and Village Green Corp. These properties are de- scribed as County Tax Map 59D(2) , Parcels 2 and 12. Charlottesville Magisterial District. This was the third appearance by the Boar's Head Sports Club to make their request. Evidence was submitted showing that adjacent and abuting property owners had been notified. A motion was made by Mr. Pickford ,j and seconded by Mr. Heath, approving their request as submitted. The motion carried unanimously. B. VA-70-11 . Georgiana C. Gordon has petitioned the Albemarle County Board of Zoning Appeals to grant a five foot variance from the ten foot setback requirements in an R-1 Residential zone. Property is located in Liberty Hills Subdivision and is described as Tax Map 76H, Lot 11 . Charlottesville Magisterial District. Mr. Gordon presented his case before the board and requested a 5 foot variance from the minimum of 10 feet allowed. His presentation included a model and layout sheet describing his proposed carport and addition. After a short discussion by the board, a motion by Mr. Pickford to approve the re- quest as submitted was made. The motion was seconded by Mr. Heath and passed unanimously. c. VA-70-12. Robert 0. and Victoria H. Burton have petitioned the Albemarle County Board of Zoning Appeals to grant a 2.5 foot variance from the 30 foot setback requirements in an R-1 Residential zone. Property is located in Deerwood Subdivision and is described as Tax Map 32C, Block 7, Lot 5. Rivanna Magisterial District. Page 56 Mr. Burton's attorney was not in attendance. It was moved by the Board to hear this request on Tuesday,December 15, 1970,at 5:30 P.M. Mr. Pickford noted that since he represented the Burtons , he would not take part in that meeting.
