In order for the amended site plan to be approved the following revisions are required: 1. [Comment] Application. There has been a LOR to this site plan previously (approved December 9, 2013). Please update the application materials to reflect that this is the second LOR. 2. [32.5.2(a)] Special Use Permit. On the Cover Sheet, please provide a note referencing the special use permit associated with this LOR as well as the conditions attached to the permit (see attached list of conditions for reference). 3. [32.5.2(a), SP2018000221 Conditions. Proposed Condition #3 of the special use permit requires proposed landscape elements located in the stormwater easement to be comprised of species on the County approved plant list. The proposed "Ilex meserveae" species does not appear to be on this list. Please review and revise the planting schedule accordingly. 4. [Comment] Landscaping Plan. It appears not all of the original landscaping elements, as approved in the original site plan, are reflected in the revised landscaping plan on Sheet S6. Specifically, shrubs surrounding Buildings A and B seem to be left off. Please include those elements on the submitted landscaping plan (see attached excerpt from 2010 site plan for reference). 5. 132.6.2(k), 4.171 Outdoor Lighting. The information panels for Proposed Light Fixture "D" were illegible. Please submit higher resolution images so this information can be read and evaluated against the County ordinances. 6. [Comment] Signature Block. Please remove the signature block on the Cover Sheet. It is not needed for a LOR (LORs are typically only signed by the lead planner). 7. [Comment] Check spelling in notes/labels on Sheets S4 and ST Revise as necessary. 8. [Comment] The special use permit associated with this LOR, SP201800022, will need to be approved before this LOR can be granted approval by the County. Frank Pohl — County Engineer 9. Development of the use shall be in general accord with the conceptual plan titled "Dogtopia" prepared by RJA Architect and Roudabush, Gale & Associates, with the latest revision date of 2/4/2019, as determined by the Director of Planning and the Zoning Administrator. To be in general accord with the Conceptual Plan, development shall reflect the following major elements within the development essential to the design of the development: a. Location of outdoor play area and fence as shown on the plan. Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance. 2. Outdoor play hours shall be restricted to no earlier than Sam and no later than 7pm. 3. Following the installation of all proposed noise mitigation improvements but prior to the final zoning inspection, the applicant must perform a noise test in accord with County Code § 18-4.18 and submit a report to confirm (to the County Engineer's satisfaction) that the proposed use will not exceed a 65-decibel maximum, as measured from the interior of the nearest tenant space. 5. A parking study shall be provided by the applicant, subject to approval by the Zoning Administrator, to confirm that there are a sufficient number of spaces on site and to ensure there are no parking conflicts with other shopping center tenants when more than the seven allotted parking spaces are needed, prior to the approval of the site plan amendment. 6. The fence shall not conceal any part of the triple window on the southeast corner of the building or either of the 2 easterly brick piers. 7. The fence material and detailing are subject to Architectural Review Board review. An 8- foot-tall fence shall have only bottom and top rails (no intermediate rails). The fence color shall be coordinated with the existing building colors and is subject to Architectural Review Board approval. 8. The following revisions are requested to make the proposal consistent with the design criteria that apply to the County -wide Certificate. 1. Building elevations of the west, south, and east elevations of the existing building with proposed changes must be submitted for review. Revised building elevations must include the west, south, and east elevations of the proposed fence as well as the locations of the proposed wall -mounted light fixtures. 2. Provide the note about no tinted or reflective films will be applied to windows visible from the EC on revised architectural elevations. 3. The landscape plan provided on S6 does not meet the previous recommendation that the "landscape plan [be] denser [and] layered." A single row of evergreen shrubs interspersed by deciduous shrubs does not look naturalistic and is not an appropriate arrangement for screening. Screening landscaping should be staggered in a minimum depth of two rows: should be layered (i.e., tallest ornamental trees in back, smaller shrubs in front); and should have a naturalistic appearance. Revise the landscape plan to provide appropriate screening and to meet previously stated recommendations. 4. The landscape plan as well as the additional plant schedule on S6 suggests that 5 new MV (Sweetbay magnolia) are proposed. However, the MV cannot be located on the plan. The label and arrow appear to point to four existing shrubs on the property that are not labeled. Rectify this discrepancy and provide a larger landscape plan that is more legible. 5. Revise the plant schedule on S6 to correctly categorize the proposed plant species: glossy abelia is a deciduous shrub and the Castle Spire blue holly is an evergreen shrub. 6. Note that two out of three species proposed are deciduous and will not provide year -around screening. With the minimal amount of landscaping proposed, this is not acceptable. The landscape plan must provide a base of evergreen screening in which deciduous and ornamental trees and shrubs are added for visual variety. 7. Note that only one of three proposed species is native to the region, the other two are non -natives to North America. Also note that an ARB standard is that no proposed plant species exceed 25% of the total amount of proposed shrubs and trees. This is to ensure that a monoculture will not be planted for health and sustainability reasons as well as to provide the naturalistic planting pattern desired. The only way to achieve this is to add more species and variety to the planting plan. Please promote natives (and especially natives that are local to the Virginia Piedmont) in a more diverse planting plan. The landscape plan (S6) shows trees on the southern property line with tree -protection fencing. At staff s last site visit in December, staff was unable to locate those trees on the ground. Conversely, the existing three Amelanchier canadensis and one crapemyrtle mentioned in a note on S6, which are north of the southern property line, on the slope and in the approximate location of the fence, are not labeled or marked "to be removed" on the plan. A site visit would clarify what exists on the property today. Please rectify the planting plan to clearly show what has been planted, what is proposed to be planted, and what is to be removed. 9. There are 20 ICST shrubs shown on the southern elevation of the building, which will fall inside the proposed enclosed area. If these are to be removed, this must be shown on the landscape plan (S6). 10. No stormwater easement has been depicted on the plan set; if an easement around the 42" storm pipe exists, it must be shown on the plans. 11. The luminaire schedule on S7 must be revised to include the three new proposed wall -mounted light fixtures. The Numeric Summary table on S7 should also be updated to reflect the additional light values added to the site plan. 12. One proposed wall -mounted light appears (in plan view on S7) to lie east and outside of the enclosed area. Clarify why this light is necessary if it lies outside of the fenced area. 13. The manufacturer's specifications for the lighting fixtures provided on S7 are too small and are illegible. Provide the manufacturer's specifications on 8.5 x 11" paper for review. Within 15 days of the date of this letter, please send me a letter (by email is acceptable) indicating whether you will or will not proceed with these revisions. If you choose not to proceed with these revisions, staff will be unable to approve your application. If you choose to proceed with the revisions, please forward me one set of revised drawings together with a memo summarizing the revisions you've made. Your decision to make the revisions will suspend the 60-day review period associated with your original submittal. However, I expect to complete the review of your revised proposal within 2 weeks of your re -submittal. If you have any questions about this action, please contact me as soon as possible. The ARB offers the following comments to be addressed with the future site plan submittals: 1. Note that a Letter of Revision application will be required to update and amend the current site plan. 2. A County -wide Certificate of Appropriateness application for Equipment, Fencing or Lighting is required prior to approval of the LOR. 3. Provide a grading plan for review. 4. Provide a landscape plan that includes denser, layered landscaping on the east and south sides of the fence, and particularly at the southeast corner. Include evergreen shrubs that will mature to a height between 4 and 6 feet. 5. The fence shall not conceal any part of the triple window on the southeast corner of the building. 6. No tinted or reflective films or similar materials shall be applied to windows visible from the Entrance Corridor. Window glass visible from the Entrance Corridor shall remain transparent. 7. Consider breaking the 72-foot length with material variation, surface relief, detailing, breaks, or proj ections/recesses. 8. Revise the elevations to show the fence in its true configuration, with vertical posts and caps and horizontal members. 9. If the SimTek material is used, choose an alternate color that is better coordinated with the building materials. Provide a fence detail. 10. Provide information confirming that the SimTek material is durable and colorfast over time. 11. Provide a utility plan for review. 12. Provide standard mechanical equipment note to future site plans: Visibility of all mechanical equipment from the Entrance Corridor shall be eliminated. 13. Provide a lighting plan that includes photometric values, manufacturer's specifications, and luminaire schedule for review. Include the standard lighting note on the lighting plan: Each outdoor luminaire equipped with a lamp that emits 3,000 or more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from adjoining residential districts and away from adjacent roads. The spillover of lighting from luminaires onto public roads and property in residential or rural areas zoning districts shall not exceed one half footcandle. 14. Provide the standard plant health note on the landscape plan: All site plantings of trees and shrubs shall be allowed to reach, and be maintained at, mature height; the topping of trees is prohibited. Shrubs and trees shall be pruned minimally and only to support the overall health of the plant. 15. Provide a grading plan that shows all grading outside the drip line of all trees to remain. 16. As recommended by the Planning Commission, the following is an analysis and confirmation that there will be sufficient parking on site with the addition of the commercial kennel use. The parking schedule of the approved site plan for Rivanna Plaza (SDP-2008-90 "Rivanna Plaza Final") shows 153 existing parking spaces on site. The proposed commercial kennel use would occupy an estimated 6,800 GSF of planned retail space within "Building A", as shown on the site plan. The parking calculation based on the approved site plan is provided below. Parking Schedule Retail: 5.5 parking spaces/1000 GSF Total GSF of Retail on site: 19,029 Required Parking: 105 spaces Daycare: 1 space/10 children + 1 space per employee Required Daycare Parking: 47 Total Parking Provided: 153 spaces Typically, for zoning clearances the parking requirement is determined by the approved parking schedule on the site plan. Rivanna Plaza, as you can see above, was approved as shopping center standard (10,000-24,999 GSF) and therefore the parking requirement for Dogtopia would be that same parking formula. The Planning Commission, however, has asked us to confirm that the site will have adequate parking using the commercial kennel parking calculation. Based on the approved site plan parking calculation for shopping center, there are 37 spaces allocated for the 6,800 GSF of retail space (5.5 spaces/1000GSF) in Building A that Dogtopia will be occupying. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a fee of $258 plus the actual cost of advertising the appeal for public hearing.
