Dear Sir:
At a meeting of the Albemarle County Planning
Commission held on May 17, 1971 , an application of Greenbriar
Limited Partnership for approval of a site plan for the
development of 138 apartment units on land situated at
the intersection of Route 743 (Hydraulic Road) and George-
town Road, known as the "Peyton Property" was recommended
for approval by the Planning Commission of Albemarle County,
subject to certain conditions, one of which was as follows :
"1. An eighty (80) foot setback for all structures
from the R/W of Route 743 (Hydraulic Road) . "
At a later meeting of the Planning Commission held
June 14th at the request of Greenbriar Limited Partnership,
the above condition was further considered by the Planning
Commission but no change was made as to the above condition
pending a review of recent setback requirements applicable
to owners of other property in a similar category as the
"Peyton Property. "
We understand that this review will be completed
prior to the next meeting of the Planning Commission to be held
Monday, June 21st, and that the matter will be further considered
at that time.
It is our understanding that the Zoning Administrator
of Albemarle County will make a decision on the site application
after the Planning Commission has made it s final approval.
It is our further understanding that Section 12-3 of the Zoning
Ordinance of Albemarle County allows for the thirty day period
within which an appeal to the Board of Zoning Appeals may be

taken which will not begin to run until after the decision
is made by the Zoning Administrator.
In view of the foregoing we think it appropriate
to await the final decision of the Zoning Administrator on
the site plan applicable before making any decision relative
to an appeal to the Board of Zoning Appeals .
If, however, it should be considered that the time
for filing an appealaruns from the date of the initial
recommendation of the Planning Commission on May 17, 1971,
we request that this letter be treated as an appeal to the
Board of Zoning Appeals.
