Dear Mr. and Mrs. Lindway:
The Board of Supervisors approved your rezoning application on January 11, 2006. Your rezoning of 4.6
acres from R-4 Residential (4 units per acre) to amend proffers was approved in accordance with the
attached proffers dated November 28, 2005/December 13,2005. Please refer to this document for any
future applications and requests on this property.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the propeliy as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
. compliance with applicable PROFFERS;
. approval of and compliance with a SITE PLAN; and
. approval of a ZONING COMPLIANCE CLEARANCE.

1. No more than two (2) dwelling units shall be constructed on this 4.6-acre property. I
2. The Owners shall not establish any additional tourist lodging in any dwelling unit other than
the one existing on the property on [date of rezoning by BOS] unless and until a site plan
meeting all the requirements of Section 32 of the Zoning Ordinance is approved by the County.
3. During the site plan review process for additional tourist lodging as referenced in proffer 2,
the existing bridge shall be evaluated by the County Engineer for its ability to provide adequate
access for the additional traffic and to assure that fire and rescue vehicles and equipment can
cross the bridge at all times, including during flood events.
4. Should the bridge be found to be inadequate by the County Engineer, the Owners shall
provide alternative methods of access prior to final site plan approval.
5. Prior to issuance of a building permit for any additional dwelling units, the Owners shall
consult with and obtain approval by the Virginia Department of Historic Resources and the
County's Director of Planning regarding the design of the proposed structure. The final building'
design shall be compatible with the existing historic dwelling in terms of form, mass, scale,
material, and overall character, as determined by the Director of Planning.
