Box 234 Charlottesville, VA 22902 RE: Proposed Expansion of Dr. Thomas Bain Property Tax Map 55, Parcel 67A - OFFICIAL DETERMINATION Dear Mr. Darnell : This letter is in follow-up to our meeting of March 4th. Your client, Dr. Bain proposed an addition of approximately 1800 square feet with basement for additional medical office space, labs and an x-ray room. Patients are treated as out-patients as in a typical private medical office center. Expansion of this use is not permitted under the current zoning, under the current Zoning Ordinance. This conclusion is reached as follows: 6 The property is currently zoned R-2 , Residential . A copy of the permitted uses by right and by Special Use Permit in this district is attached. ® The current and proposed use is "professional offices, including medical , dental and optical . " • This use, professional offices, is not permitted within the R-2 , Residential district by-right or by special permit. ® The current use is "grandfathered" or non-conforming to the zoning of the property. As such, it may be continued. Pursuant to Section 6 . 4 . 1 (also attached) , any building enlargement, extension, etc. shall conform to the Zoning Ordinance. March 13 , 1991 Samuel E. Darnell Page 2 As I am aware of them, your client's options are as follows: 1. Rezone the property to a district which permits professional offices, such as CO, Commercial Office. It appears that a setback variance would also be necessary for the proposed location of the addition. Please consult Planning staff for the Zoning Map Amendment and this Department for the variance. 2 . Request a Zoning Text Amendment which would amend the R-2 district to include this use. Please consult the Planning Department. 3 . Use the addition for a by-right R-2 use or for a Special Permit use after Board of Supervisors approval . I am aware of this property history with special permit-339 and variance 74-31 approvals. However, these do not permit further expansion at this time. If you are aggrieved, you may appeal in writing within thirty (30) days of the date of this decision. If you have any questions, please feel free to call . Patterson Zoning Administrator AMP/sp cc: Ron Keeler Enclosures 6.0 NONCONFORMITIES 6 . 1 CONTINUATION 6 . 1 . 1 Any use, activity, lot or structure lawfully in existence on the effective date of this ordinance which does not conform to the provisions of this ordinance relating to the district in which the same is situated, may be continued in accordance with the provisions of this section. 6 . 1 . 2 No change in title to any property subject to the provisions of this section, including but not limited to the demise, renewal, expiration, termination or modification of any leasehold interest, shall impair the nonconforming status of such property. 6 . 1 . 3 Any such use, activity or structure which is discontinued for more than two ( 2) years shall be deemed abandoned and shall thereafter conform to the provisions of this ordinance relating to the district in which the same is situated. 6 . 1 . 4 Whenever any such use, activity or structure is chanced to a conforming or a more restricted nonconforming use, activity or structure, the original use shall be deemed abandoned. 6 . 2 REPAIRS AND MAINTENANCE On any building devoted in whole br in part to any noncon- forming use, work may be done on ordinary repairs or on repair or replacement of nonbearing walls, fixtures , wiring or plumbing, to such extent that the structure is kept in a usable condition. Nothing in this ordinance shall be deemed to prevent the strengthening or restoring to a safe con- dition of any structure or part thereof declared to be unsafe by any official charged with promoting public safety upon order of such official. 6 . 3 CHANGES IN DISTRICT BOUNDARIES Whenever the boundaries of a district are changed, any uses of land or buildings which become nonconforming as a result of such change shall become subject to the provisions of this section. 6 . 4 EXPANSION OR ENLARGEMENT 6 . 4 . 1 The use of any building or structure shall conform to the provisions of this ordinance relating to the district in which the same is situated whenever such building or struc- ture is enlarged, extended, reconstructed or structurally altered. -78- ( Supp. #31 , 3-5-86) 23.0 COMMERCIAL OFFICE - CO 23 . 1 INTENT, WHERE PERMITTED CO districts are hereby created and may hereafter be established by amendment to the zoning map to permit development of administrative, business and professional offices and supporting accessory uses and facilities . This district is intended as a transition between residential districts and other more intensive commercial and industrial districts . 23 . 2 PERMITTED USES 23 . 2. 1 BY RIGHT The following uses shall be permitted in any CO district, subject to the requirements and limitations of these regulations : 1 . Administrative and business offices . 2 . Professional offices, including medical, dental and optical. 3 . Financial institutions. 4 . Churches, cemeteries . 5 . Libraries, museums. 6 . Accessory uses and structures incidental to the principal uses provided herein. Such uses in com- bination shall not occupy more that twenty ( 20 ) percent of the floor area of buildings on the site. The following accessory uses shall be permitted: -Eating establishments; -Newsstands; -Establishments for the sale of office supplies and service of office equipment; -Data processing services; -Central reproduction and mailing services and the like; -Ethical pharmacies , laboratories and estabishments for the production, fitting and/or sale of optical or prosthetic appliances on sites containing medical, dental or optical offices; - (Repealed 3-17-82 ) • -148- ( Supp. #10 , 3-17-82 ) 14.0 RESIDENTIAL - R-2 14 . 1 INTENT, WHERE PERMITTED This district (hereafter referred to as R-2) is created to establish a plan implementation zone that: -Provides a potential transition density between higher and lower density areas established through previous develop- ment and/or zoning in community areas and the urban area; -Permits a variety of housing types; -Provides incentives for clustering of development and provision of locational, environmental and development amenities . R-2 districts may be permitted within community and urban area locations designated on the comprehensive plan in proximity to compatible development where water and sewerage utility services are available or are to be available within two years . 14 . 2 PERMITTED USES 14 .2 . 1 BY RIGHT The following uses shall be permitted subject to require- ments and limitations of this ordinance: 1 . Detached single-family dwellings . 2 . Cluster development of permitted residential uses . 3 . Rental of permitted residential uses and guest cot- tages, provided that yard, area and other requirements of this ordinance shall be met for each such use whether or not such use is on an individual lay-out. 4 . Electric, gas , oil and communication facilities , excluding multi-legged tower structures and including poles, lines, transformers , pipes, meters and related facilities for distribution of local service and owned and operated by a public utility.
