As stated in my telephone call to you this week, I
have cancelled the public hearing scheduled for the Board
of Zoning Appeals on August 20, 1974. I take this action
based on the fact that in my opinion as Zoning Administrator
I� have taken no action nor made a decision which is subject
to appeal.
•
Mr. Bernard P. Chamberlain, your attorney, has today
filed a new appeal which is appealing my cancellation of
your first appeal. This second appeal will be advertised
and scheduled for a special hearing to be° heard by the
Board of Zoning Appeals on August 27, 1974, 5:30 p.m.

Gentlemen : Re : Application of T. Eugene Worrell .
On July 26, 1974, I failla.golor my clients, Mr. and Mrs . Marvin
Rosenblum, an appeal of aftruling of the Zoning Administrator relative
to an application attacheci thereto by which Mr. T. Eugene Worrell
sought a Special Use Permit for a location of "professional offices"
on 4.4 acres of the Reynolds A-1 property on Hydraulic Road. Accompany-
ing that appeal was a letter to you of that date, a copy of which is
hereto attached .
Thereafter, my clients were officially notified by the Zoning
Administrator that she had not in fact made a ruling upon the said
application and that the appeal had been dismissed, even though a
proposed hearing on it had already been advertised in the Daily
Progress .
Thereupon, in behalf of my said clients, I filed an appeal from
her decision dismissing the aforesaid appeal, inasmuch as her action
in dismissing the aforesaid appeal was "a decision of the Zoning
Administrator" appaciable under the provisions of Section 12-3 of the
County Zoning Ordinance .
This appeal is designed to bring into issue whether the Zoning
Administrator had in fact determined that the applicant' s proposed
use for the said 4 .4 acre tract was a permissible use as "professional
offices" under a Special Use Permit for an A-1 District, whether the
Zoning Administrator had jurisdiction and authority to dismiss the
aforesaid appeal, and whether on the merits the proposed use is in
fact primarily for "professional offices", Another purpose of the
appeal is to stay proceedings upon such application by the Planning
Commission to enable consideration to be given to an application for
an amendment of the Zoning Ordinance to designate a new category
permitting by Special Use Permit a corporate headquarters or executive
office in such A-1 District.

VA-74-29 . Mr. & Mrs. Marvin Rosenblum. Applicants are
appealing the Zoning Administrator' s opinion of the
definition of professional offices. Professional offices
are permitted in an A-1 Agricultural Zone with a Special
Nsf, Permit. The Zoning Administrator accepted an appli-
c,cation from Mr. T. Eugene Worrell for a Special Use
Permit to allow professional offices in an A-1 Agricul-
tural Zone. Applicants challenge that the proposed use
is a professional office . Property is located west of
Route 743 between Hydraulic Road and the Charlottesville-
A.themarle Airport, Property is further described as
County Tax Map 45, Parcel 41 , Charlottesville Magisterial
District.
