RE: Use Determination As Per Section 22.2.1
Yesterday I met with Ted Denby who owns an electrical wholesale
business located on Brookway Drive (same area where Taylor Body
Shop wants to locate) . Mr. Denby' s business is located on lot
6 and he proposes to expand onto lot 7. This area is zoned C-1.
Permitted uses under the C-i district do not specifically mention electrical wholesale businesses.
In my opinion, it appears that such a use would be no more inten-
sive or dissimilar in character than many of the uses currently
identified in the C-i district . Also, Section 21. 1 encourages
wholesale type businesses.
In accordance with Section 22 .2. 1 , I would like to solicit your
comments pertaining to the above. It might be appropriate for us
to go take a look at the site before we make a final decision.
Please let me know what you would like to do.

Dear Mr. Humphrey:
Regarding your notice dated June 20th of the above file, the following
comments are made.
I requested a plan from Mr. Roudabush which was supplied, and I have
reviewed same. There is nothing in the proposed use of this building and
its site plan which, in my opinion, would affect adversely the Atwood
property plans which have been approved preliminarily by your office with
the following exception.
If any rooftop mechanical equipment is contemplated for the building,
we would request that this be screened through the use of any of a number
of commercial products or a screen of custom design to effectively hide
any of the rooftop equipment.
I am familiar with the nature of Mr. Roudabush's business and see no
other adverse aesthetic impact on the project as it is envisioned.
As you know, part of the property which I controlled was conveyed to
Mr. Cotten with the stipulations that this property not be used for any
building purposes but rather would remain in its natural state, being used
as a right-of-way for future sewer lines. I see no conflict with this re-
quest from Mr. Roudabush for the variances and would support his request.

Dear Mrs. Miller:
This letter is in connection with my request for two variances
required to develop the site plan as shown on the attached drawing.
This facility is designed to be used exclusively by our own business.
Request number one is for a variance of 11 feet from the
required 50 foot rear setback specified in article 7-4 of the zoning
ordinance. By reference to our site plan you will note that if the
building were located 50 feet from the rear line the result would be
that our building would project about 35 feet in front of the building
on the adjacent lot. Also, a 50 foot rear yard would reduce the
parking space in front of the building and require that more parking
be placed in the rear of the building resulting in less accessible
parking spaces. The property adjacent to the rear has a steep
incline, rising above this site, therefore any development on that
tract will be located further from our rear line. The adjacent
property is screened by an existing barrier of trees and planting.
Request number two is for a variance to the parking require-
ments of article 11-7-9. Our site plan provides more than adequate
parking for the requirements of our business. The zoning ordinance
does not break down parking requirements for various types of
businesses. Our building will be a professional office building
rather than a "commercial" operation. Observation of ordinances
in other jurisdictions indicate that one space for each 300 square
feet is sufficient for office buildings. Our plan furnishes one space
for each 166 square feet. It is noted that our company-owned vehicles
spend the day on job sites except for a few minutes in the morning and
afternoon. It would be very unusual for us to have more than 3
customers (including sales or service personnel) in our office at a
time. No vehicles are housed overnight at our office.

We feel that the request for both variances meet the criteria
set forth in article 12-2-3 for the following reasons:
a) That the strict application of the ordinance would produce
undue hardship in that it would require us to build a two
story building which would be unsuitable for our operations
and require construction of unnecessary facilities for
un-needed parking.
b) That such hardship is not generally shared by other
properties in this vicinity due to the fact that our
business is unique in that most of our employees spend
their time out of the office, but large quarters are
necessary for the in-office procedures of our business;
such as drafting and record storage.
c) That the granting of these variances will not be of
substantial detriment to the adjacent property and the
character of the district will not be changed because
this would only affect one adjacent tract which is well
screened by trees and topography.
