Miller: I am going to answer your three letters, two dated February 14th, 1974, and one dated February 13th, 1974, in this letter of which I am sending you three copies so you can file it in each of these three files . First, the interpretation of the sign ordinance: I agree with your interpretation that the applicant is entitled to the benefit of any doubt in the ordinance and is therefore entitled to a thirty (30) foot sign even though his building may not be that tall . Second, on the subject of enforcement of conditions placed on a variance, I believe the Zoning Ordinance provides that any violation of the Ordinance can be punished by criminal proceedings and that the Ordinance can be enforced by civil proceeding including injunction or show cause why the permit should not be revoked. I believe the Zoning Administrator and not the Board of Zoning Appeals is charged with enforcing the conditions, and that you should therefore write to Black Industries stating that if the conditions are not followed, civil and criminal action will be initiated against them. With respect to Dr. Hurt 's pole barn, I recommend that you immediately contact Mr. Helvin, the Assistant Commonwealth 's Attorney, and inform him that you are getting a criminal warrant against Dr. Hurt, find out what day he would like to have it set, and then get Mr. D. I interpret it to mean if a building is only 15 feet high and the applicant wishes to erect a sign a 25 feet in height he may do so since it is under the maximum 30 feet but does ex- tend above the eave line of the building. Your opinion on this matter as soon as possible will be appreciated since I have two applications pending now.
