Dear Mr. Smith:
The Board of Zoning Appeals has requested that this office
investigate the sign on this property to determine if it complies
with the Zoning Ordinance.
Mr. Evans, Zoning Inspector, has made an inspection and his
report indicates that the main sign is located 28'- 3" from the
centerline of Route 6 which would put it 3'- 11" fran the right-
of-way. The ordinance requires 30'- 0".
It will be necessary for you to apply to the Board of Zoning
Appeals for a 26'- 0" variance. The setback is measured to the
edge of the sign structure (not the base of the support) .
Your original sign application was not approved and no
permit has been issued.
Please contact this office to discuss the measures that must
be taken to clear up this situation.

ALBEMARLE COUNTY BOARD OF ZONING APPEALS
March 20, 1974
The Albemarle County Board of Zoning Appeals held a public hearing on
March 20, 1974, at 5:30 p.m. , in the Board of Supervisors Meeting Room, County
Office Building, Court Square, Charlottesville, Virginia.
Members present were Messrs Bain, Brown, Heath and Roudabush.
Member absent was Judge Amato.
There being a quorum present, Mr. Bain, Vice Chairman, called the meeting
to order at 5:30 p.m.
On motion of Mr. Brown, seconded by Mr. Heath, the minutes of February 12,
1974, were unanimously approved with the following correction:
Page one (1), Paragraph seven (7), change the word "Attorney" to Architect.
It should read, "Mr. Johnson, Architect for the applicant, appeared before
the Board".
1. VA-74-04. Smith Chevrolet, Inc. Applicant requests the Board of
( Zoning Appeals of Albemarle County to grant a variance to permit 120
square feet of aggregate area of two (2) signs in a B-i Business zone
instead of the 100 square feet allowed. Property is located at the
intersection of Route 6 and Route 726. Property is further described
as County Tax Map 130, Parcel 27, Scottsville Magisterial District.
Mr. L. A. Beveridge, representing General Motors, appeared before the
Board.
Mr. Beveridge stated that he is requesting permission to erect two (2)
signs,.. one product sign and one identification sign; that ally,ofthe existing signs,
which are in disre air, will be,replacedby the requested signs; that Smith
Chevrolet has.signed a_ten (10) year service and maintence contract with General
Motors.
On question of Mr. Bain, Mr. Beveridge stated that the signs are General
Nbtors' standard signs; one is nine feet by nine feet (9'x9') and the other is six
feet by six feet (6'x6') making an aggregate area of 117 square feet; therefore,
he is requesting a seventeen (17) foot variance.
On question of Mr. Brown, Mr. Beveridge stated General Motors has smaller

signs but they are designed to be wall signs.
On question of Mr. Roudabush, Mr. Beveridge stated that he has not run
into problems in other jurisdiction that he recently got a variance for two (2)
six feet by six feet (6'x6') signs in Loudoun County. -
On question of Mr. Brown, Mr. Beveridge stated that Mr. Smith has signed
a lease with General Motors for both signs.
Mr. Bain read Section 15A-6-1 of the Zoning Ordinance.
On question of Mr. Roudabush, Mrs. Miller stated that a two (2) faced sign,
back to back, is considered one sign.
On question of W. Heath, W. Beveridge stated that the proposed signs are

from a proposed shopping center.
Mr. Beveridge showed a plat of the subject property.
No persons appeared in favor of or in opposition to the application.

SUBJECT: Sigfried Oil Company Site Plan Variance
DATE: November 28 , 1975
The applicant received site plan approval for gasoline pumps adjacent
Smith Chevrolet Sales on October 21, 1975 . One of the conditions of
site plan approval (see attached) was "dedication of 10' strip along
Route 726. " This is a requirement of the newly adopted site plan ordi-
nance (adopted August 1, 1975) .
This requirement to dedicate 25 ' from the centerline of roads having less
than a 50 ' right-of-way has always been a part of subdivision approval,
however, with the adoption of the new site plan ordinance, all site plans
are now also affected. The purpose of the requirement is to eventually
obtain a 50 ' right-of-way on all roads.
The applicant is requesting relief from this requirement, and we have been
informed by the County Attorney' s office that the Board of Zoning Appeals
should hear this variance or any other variance from the site plan require-
ents, since they are a part of the Zoning Ordinance.

The Albemarle County Planning Commission at their meeting on October 21, 1975,
approved this site plan subject to the following conditions:
1. Fire Marshal approval;
2. Pumps and island setback 75' from centerline of Route 6 ( This allows for
25' from centerline of existing right-of-way, plus 20' for proposed right-
of-way, plus 30' normal setback from right-of-way line ) .
3. Pumps and island setback 55' from centerline of Route 726 ( This allows for
15' from centerline of existing right-of-way, plus 10' additional dedication, plus 30'
normal setback from right-of-way line. )
4. Dedication of 10' strip along Route 726 entire length of subject property;
5. Virginia Department of Highways and Transportation approval of proposed entrance.
