He felt that an architectural review board should be formed. Dr. Catlin was of the same opinion and tended to be in favor of the proposal. He felt that more time was needed to evaulate the proposal. Mr. McChre motioned to defer action until January 22, 1973 to provide time to meet with the petitioners and discuss the matter further. The motion was seconded by Mr. Rinehart and approved by the unanimous vote of those members present. (The Commission is to meet with the applicant on Wednesday, January 17, 1973, at 12:30 p.m.) 5. SP-230. Wharton C. Herndon has petitioned the Board of Supervisors to locate a permanent mobile home on 187. 5 acres zoned A-Z Agricultural. Property is situated west of Route 7Z2 at North Garden, just east of Southern Railroad. Property is described as County Tax Map 99, Parcel 36 (pt. thereof)¢--Sa uel Miller District. The staff presented its report after which Mr. Herndon stated that a three year temporary permit was ameniable to him since. he desires to build a standard dwelling. The public hearing being concluded, Mr. Roudabush motioned for approval of the request for a temporary permit for 3 years subject to Health Department approval of water supply and a septic tank system, and a setback from Route 712 satisfactory to the staff, with a 100 ft. as a guideline. The motion was seconded by Mr. Rinehart and was approved by the unanimous vote of 'those members present. 0 SP-23Z. I. J. Breeden has petitioned the Board of Supervisors to place a convenience food store (Grocery Store) On land containing 0. 9 acres in the "Southwood Mobile Some Park", on which a building exists. Property is des- cribed as County Tax Map 90A, Parcel Z (part thereof) Scottsville Magisterial District. The staff presented his report suggesting approval. Mr. McClure at this time excused himself from discussion and voting on this matter. No one appeared in opposition. Mr. Carr was concerned with approving the permit forever, and other owner- ship which might create problems. He felt that if we grant, there ought to be provisions for denying it later, or revoking it, if it became objectionable. A dis- v. cushion was held on time periods relative to approval. Page 771 Mr. Carr motioned approval of the petition for a period of 5 years subject to administrative review annually thereafter, and is issued as an accessory use to the J mobile home operation only. Mr. Tinsley seconded the motion, which was approved unan- imously by those members present. • 7. Use Permit 72-01. Nan Therese Rothwell has petitioned the Board of Supervisors to amend Article 2-2-25 to provide for a new permitted use under the Special Permit provisions to be known as " Cottage Industry ". Said use being defined as a form of light manufacturing limited to hand crafts produced by persons residing on the premises and not more than 2 additional apprentices, in connection with which there may be an inventory of raw materials, work in process, and finished produce upon the permises. No retail sales shall be upon the premises without a special permit as provided in Section 2-1-25(15) of this ordinance. The property which has caused this application is described as County Tax Map 56, Parcel 34, White Hall Maigsterial District. The use if approved, would apply to all A-Z zones. The petition was deferred until January 22 , 1973 at the request �x1 the applicant's attorney because of not being able to attend the meeting because of • i weather. The secretary notes that a Mr. Mallory and Mr. Baldwin did attend tonight's meeting. Mr. E. C. Wingfield, attorney, was also in attendance representing the aqja- cent property owner: .! 8. Use Permit 72-02. Certified Welding has petitioned the Board of Supervisors of amend Article 8-Z "Uses Permitted" in an "Industrial, Limited, District M-Z to permit "Welding and Machine Shops and related storage. " The property which has caused this petition is described as County Tax Map 90, Parcel 35Q. . Scottsville Magisterial District. The use if approved would apply to all M-Z zones. This petition could not be heard because of improper legal notification caused by the local newspaper. At this time the Chairman called for site plans and subdivision. 1. Brinnington Subdivision Preliminary - Mr. Morris Foster, surveyor presented the plat indicating a division of land involving a request for a restricted road servicing two lots. Several persons appeared in opposition to the subdivision itself. However, it was pointed out by the chairman and planner that the plat conformed to the requirements of the ordinance. The only reason it was before the Commission was the desire to have a restricted road as required. Page 759 likow December 11 , 1972 j WORK SESSION This was a special work session of the Albemarle County Planning Commission held at 7 : 30 p .m. Present were Dr . Avery Catlin, Chairman; Clifton McClure, Vice-Chairman; Messrs . Jack Rinehart , David Carr, William Roudabush, Wilbur Tinsley , and Mrs . Ellen Craddock. Absent were : Dr . James Sams and Mr. Louis Staley. Also in attendance were : Mr . Herbert A. Pickford , Mr . Lloyd Wood , and Miss Mary Joy White; and two representatives from the University of Virginia Law School : Mr . Fred Payne and Mr . Gary Nuckols . There was a discussion of whether the new subdivision ordinance would be considered "a new subdivision ordinancd' , or whether it would be an "re-inactment of present subdivision ordinance" . It was agreed that there would be an "re-inactment of present ordinance" . a. SP-213 I. J. Breeden has petitioned the Board of Supervisors to place a convenience food store (Grocery Store) on land containing 0. 9 acres: in the "Southwood Mobile Home Park " on which a building exists. Property is described as County Tax Map 90A, Parcel Z (part thereof) . Scottsville Magis- terial District. This was brought before the Commission again because the staff report incorrectly represented this area as an R-3 zone and the Commission proceeded Planning on this basis . However , the Commission reiterated their denial of zoning to B-1 but indicated their preference of a Special Permit approach to the desires of the landowners . There being no further business , the meeting was adjourned . Secretary Page 753 Noe r.rry Therefore, Mr. Carr made a motion to deny ZMP-254, which was seconded Ci" by Mrs. Craddock and carried by an 8-1 vote with Mr. McClure abstaining. Mr. Minor was asked to convey the results to Mr. Breeden so that he could apply for a Special Permit. E. SP-218. Clifford Jackman has petitioned the Board of Supervisors to locate a campground on land situated on east side of Route 29 South near the Albemarle-Nelson County line. Property is described as County Tax Map 117, Parcel 5 (part thereof) - containing 20 acres. Scottsville Magisterial District. The staff's report was presented -by Miss White. She stated the Planning staff did not have a site plan, one a sketch that Mr. Jackman had presented to them. Mr. Jackman was present. He said he planned to do all the Work himself and would try to give them a better sketch. Dr. Catlin said he thought that in order for the Planner to give recommenda- tions, they would have to have more information such as where the septic ,tan.k will be located, the dfects on Cove Creek, the kind of camp sites, the degrees and ingress of traffic. Mr. Jackman did not know exactly how to get this sort of information, so Dr. Catlin asked Miss White to get help for him from the Planning Office. - Mr. Carr asked if this would be a privately owned operation or if it would be identified with other campgrounds. Mr. Jackman said it was privately owned. Mrs. Craddock wanted to know if there would be a time limit set on campers. Mr. Jackman said there would be mostly overnight campers, but a limit of two weeks would probably be set. Mr. Roy Petty, a nearby property owner of 190 acres said the entire site would be visible from his house. He also said Dr. Strider, adjacent property owner, was in opposition to this proposal. Mr. Petty said he would like to know what kind of building are proposed and in general, he would like to know more about Mr. Jackman's operation. Page, 752 his home. He elaborated on the type of activity that he could see from his house. Messrs. John SToffer, Ma wyer, John R. Wood and Mrs. Fowler expressed opposition to the request also, saying they concurred with comments already made. The public hearing was closed. Mrs. Craddock proposed that a committee be appointed to view the site. Dr. Sams said he would be inclined to vote against such a venture and doubted if his opinion would change even—if he saw the property. After a short discussion, Mr. McClure made a motion, seconded by Dr. Sams to deny ZMP-253. The motion carried by an 8--1 vote with Mr. Staley abstaining. D. ZMP-254. I. J. Breeden, to rezone one acre from A-1 Agricultural . to B-1 Business. Property is situated in the Southwood Mobile Home Park on Hickory Street. Property is described as County. Tax Map 90A, Parcel 1. Scottsville Magisterial District. Miss White presented the staff's report stating that this convenience store that the applicant desired under 4000 sq. ft. could be obtained under a Special Permit in an R-3 zone. [The staff report incorrectly represented this area as an R-3 zone and the Planning Commission proceeded on this basis. ) Mr. Minor was present to represent Mr. Breeden. Mr. Minor explained that the existing building was being utilized as a laundromat and storage area, but that Mr. Breeden wished to convert it to a small convenience grocery store for the residents of Southwood Mobile Home Park. After the public hexing was closed, Mr. McClure asked to be excused• from discussion and voting due to possible conflict. Mr. Carr had questions regarding $ g parking area. It was ascertained, according to Aubrey Huffman, that there were approximately 50 parking spaces in a paved lot. Mr. Carr said he would move for approval tf a Special Permit, but Dr. Catlin commented it would not be proper since only the rezoning application was before them. ' 1 • rtY oI ;.
