Clarke Zoning Administrator and Building Inspector County of Albemarle 411 East High Street Charlottesville, Virginia 22901 Re: Rosa Powell Variance (VA-75- 15) and Building Permit Dear Mr. Clarke: You will recall from the hearing before the Board of Zoning Appeals on May 6, 1975, that I represent Mrs. Ruth Fitzgerald, whose property adjoins and lies north of the Powell property. It is our understanding that based on the Board's grant- ing of a variance of 10 feet on the southern property line (adjoining the property of Grant Cosner), that your office intends to issue a building permit for the addition of two bedrooms on the Powell home. Inasmuch as it was represented that the property does not violate the sideyard setback requirements on the northern side (adjoining Mrs. Fitzgerald's property) and further that the addition would not violate that sideyard setback line, we did not object at the hearing to the granting of the variance. However, our acquiescence was based on the assurance that the office of the building inspector would take reasonable steps to see that there would not be a viola- tion of the sideyard requirement along the northern boundary. We, therefore, request that you or some representative of your office make an inspection of the property for the purpose of determining that the property as it now exists and with the future addition will not violate the 25-foot setback on the north side of the property. I might point out that there has been some disagreement PAXSON, SMITH. BOYD, GILLIAM & GOULDMAN INCORPORATED Mr. Hartwell P. Clarke May 7, 1975 Page Two between the Powells and the Fitzgeralds regarding the correct boundary lines and Mrs. Fitzgerald does not believe that the exist- ing fence line can be assumed to reflect the correct property line between the properties. As we stated at the hearing, we have no objection if there is no violation of the setback line on Mrs. Fitzgerald's side of the property. However, we look to your office to see that the new construction does not in fact violate that sideyard require- ment.
