Dear Sirs:
We regret that we are unable to attend your hearing on
April 22, 1975 regarding an application by William and Mary Sihler
for a five foot variance from the required thirty foot setback
line on Lot 9, Block D, Section 8 of County Tax Map 60A. We
request that you read this brief letter at the appropriate time
during that hearing.
We understand that the basis for the variance request is a
tentative plan by Mr. Daley Craig to locate a large traffic circle
in front of the Sihler's property at the south end of Sturbridge
Road in order to bring the roads of the Old Forge area up?-to the
county's standards prior to deeding the property over to that
governmental agency.
In our judgement, such a circle is unnecessarj- for safety
or for service, would be expensive both to build and to maintain,
and represents a potential traffic hazard for young children in
the area.
In addition, the construction of such a circle with a mere
ten feet of buffer land at its southern rim would make extension
of the road into the undeveloped land to the south much simpler
at a future time. Such an extension would drastically alter the
character of Sturbridge Road, since it would then become a short•
cut to K.Mart and the other commercial developments to the north.
The lesson of Four Seasons and Berkeley is still fresh in our
minds.
For the above reasons, we speak in opposition to the variance
request and hope that the Sihlers, the Coopers and Mr. Craig
reconsider simply terminating the road where it now ends. If
Mr. Craig deeded this property to the Coopers and the Sihlers, it
would save him the cost of paving the circle, would save the county
the cost of maintaining the circle and would help preserve the
present character of the area.

I am writing to correct a possible misimpression wh:pch might have been
created at this morning's Board of Supervisors' discussion of the road situation
in the Old Forge Road section of Hessian Hills; to wit: that my not having signed
approval to take a portion of my lot (lot 9, block D) for a turnaround at the end
of Sturbridge Road was an arbitrary or capricious action to delay the improvement
of the roads. My wife protested this implication at the meeting, and I am writing
to put her comments before the Board and to support them in detail.
The facts show, in fact, that I have been attempting to get some
action with respect to the end of Sturbridge Road since the summer of 1972.
At that time I was approached about selling the lot. Because the
prospective buyer was concerned about thc=::elfin the temporary and unpaved
condition of the turnaround which is presently at the end of Sturbridge Road,

of Sturbridge Road. I was told that Mr. Craig had none and considered the road
complete.
I then made inquiries of the County Panning Officd and was advised that
funds of some type were being held on deposit for the roads of this area. I was
told to write the Board of Supervisors requesting that they be applied to completing
Sturbridge Road. Together with Mr. Robert H. Cooper, my neighbor, I wrote the
Board on Septdmber 11, 1972, with this request.
Mr. Cooper and I were favored in the following months with copies of
correspondence, occasionally vitriolic, between parties which included Miss Mary
Joy White of the Planning Office and Mr. Craig. The last letter refers to a
conference planned for January 23, 1973. I believe Mr. Cooper wrote in the summer
of 1974 to ask about any further information on this matter. I did not receive•
a copy of whatever reply may have been sent him.
The next I heard on this question was from neighbors on Tuesday, March 11,
1975, who told me that plans had been prepared for road work in this area, part
of which would install an 80 foot circle together with a 10 foot easement around it
at the end of Sturbridge Road. This proposal would require me to give up approximately
25 feet of a 200 foot lot, and it would also push the building line back some five
feet from the one established in the deed.
Given the odd rh:.pe of the lot combined with the new sidcyerd spccific,ctiees
in the proposed new 2onin ; rc ulations, the en•larzed turnaround and f3etbnc'k could
greatly complicate development of the lot.

On Wednesday Mr. Cooper showed me information he had obtained from
the plans which Mr. Craig had given him, identifying more clearly where the
turnaround would be located.
Thursday, March 13, I called the Flaming Office to inquire about the
process of getting a variance granted which would preserve the "deed building line"
aadthe building line for the property despite the turnaround. I was told that if
I could get down before the office closed that day, I might be able to get the
appeal on the agenda for the April meeting of the Board of Zoning Appeals.
Unfortunately, my schedule did not afford me the time to prepare an
appeal that day and get downtown. I drafted the appeal that evening, however,
and I took it downtown on Friday, March 14, despite the sleet storm to which we
were treated that day. I was told that I had missed the deadline for April and
would have to wait for the May 13 meeting.
I sincerely regret this delay, but it is hard to imagine how I could
have acted more promptly. After all, even though I began inquiries in 1972,
it is only a week ago that I learned through the grapevine what was proposed and
had any idea that I would require a variance.
All I am asking for is time to learn whether a variance will be granted
before I give up a chunk of a difficult lot. I have not complained about the
loss of the property. I have not even complained about the fact that I have not
been informed of what has been going on for over two years. I have not complained
that Mr. Craig is not particu'arly interested in considering other options which
might cost him less and which might be more suitable to the property owners. But
I do not wish to be tagged as acting thoughtlessly,
If it is possible to accelerate consideration of my rqquest for a
variance, so hhat it can be taken up in April, I would appreciate the help.

Re: Request for setback variance for Lot 9, Block D, Section 6 of Hessian Hills
(County Tax Map 060A-D9)
Gentlemen:
I have recently learned that the State Highway Department wishes Mr. Daley Craig,
developer of Section 6 in Hessian Hills, to make certain improvements in the
roads of the section before the roads will be accepted into the state system.
One of these "improvements" would replace the "temporary turn-around" at the
end of Sturbridge Road with a permanent turn-around which is designed to be
slightly larger and somewhat further down the road.
My understanding is that the proposed turn-around will be 80 feet in diameter
with an additional right-of-way of 10 feet on all sides, bringipg the total
diameter to 100 feet. The road is presently 50 feet wide, so the new turn-around
will take 25 feet of Lot 9 in Section D, which I own.
The present building line, according to the terms of the deed, is 50 feet from
the edge of the road, 75 feet from the center. This line will not be changed
by the construction of the turn-around since the deed specifies that the building
lines shall be those shown on the section plat.
What will be altered, however, is the setback required by the County. At the
moment this is30 feet from the edge of the road or $5 feet from the center,
well within the 50 feet (75 feet from the center) established by the section plat.
When the turn-around in installed and the edge of the road is moved 25 feet on to
my lot, the 30 foot setback requirement will extend the total setback 80 feet from
the center. This is some five feet more than the deed restrictions impose.
Five feet may seem like a small amount on top of what is being taken by
the turn-around. The shape of the lot is very irregular, and it has always been a
problem to fit a house site on it. The recent side-yard regulations have made this
even more difficult. In the circumstances, therefore, I am not enthusiastic about
authorizing the construction of the turn-around at all and certainly not until a
variance is granted for this lot.
I therefore respectdully request that the "50 foot building line" as specified in
the deed and plat of Section 6, Block D, shall apply to Lot 9 rather than the
30 foot setback imposed by the Zoning Ordinance.
