Brian,
As discussed this morning, per Section 17-411 (copied below), the VSMP plan for this project is close to being voluntarily
withdrawn. You have 6 months from the time of the last issued comments to submit a revised application. A 6-mth
extension can be granted at your request. Please reply by April 26, 2109 with a request to defer this project if you would
like it to remain active, otherwise your application will be deemed voluntarily withdrawn on April 27tn
Sec. 17-411 Deferral of review of application; when application deemed withdrawn. The administrator's review
and action on an application may be deferred, and the application may be deemed withdrawn, as follows:
A. Request to defer by owner. An owner may request that review or action on the application be deferred
for a specified period up to six (6) months. If during the deferral period the owner does not request the
administrator to take action on the application as provided in section 17-408 within six (6) months after the date
the deferral was requested, the application shall be deemed to have been voluntarily withdrawn.
B. Failure to submit revised application. If an owner fails to submit a revised application to address all of
the requirements within six (6) months after the date of the written notice as provided in section 17-410(D)(1),
the application shall be deemed to have been voluntarily withdrawn by the owner.
C. Extension of deferral period or period to submit revised plan. Before the deferral period in subsection
(A) expires, the owner may request that the administrator extend the period before the application is deemed to
have been voluntarily withdrawn. The request must be received by the administrator before the deferral period
expires. The administrator may grant one extension for a period not to exceed three (3) months, taking into
consideration the size or nature of the proposed development, the complexity of the review, and the laws in
effect at the time the extension request is made.
