SUBJECT: Thomas variance
The only interest which the Planning Department has in this matter
is concern for the applicant should he wish to subdivide in the
future. Wherever he locates his home, he should ,,eep in mind
the subdivision and zoning requirements , that is minimum two acres
with 30 feet front, 25 foot side and 35 foot rear yards .
It appears from the sketch that the location of the existing
residence may prevent him from getting , the needed two acres .
If he does not subdivide at this time, he will be required to
get site plan approval (for more than two single family units
on one parcel) and we would so advise him at that time.
The alternative would be to build at the back of the site.
He could request the Planning Commission to approve an
easement to serve a two-acre lot. Since there is an existing
driveway, the Commission would probably look favorably upon
locating the easement there , although normally staff would
recommend that the easement be kept the setback distance from
a dwelling. To my knowledge there is no requirement that the
easement has to be a certain distance from the dwelling .

Ruling :
Mr. Thomas was administratively denied a variance of 50 ft .
from the right-of-way established by the recently adopted
Scenic Highway Designation . (A required 150 ft . setback -
no structure shall be constructed within such 150 ft . ) This
language is specific and non-discretionary .
A home is planned by the applicant .
PUBLIC INPUT :
Mr. Frelin Compton telephonedJuly 23 , 1976 , and voiced
concern that exceptions to the Scenic Highway setback
would eventually erode the purpose of the Scenic Highway
designation .

Mrs . Robert Cross telephone\ our office and spoke to
D. L . Woodson , Inspector on Thursday , August 5 , 1976 .
The Cross ' recently bought property from the Thomas ' .
She stated that her concern was not whether or not it
was a hardship , however , one of the neighbors has stated
that if a presidence is set by Mr . Thomas ' variance being
granted that he will make application for a variance for
himself by Monday morning .
