Dear Mr. Holdren:
The Zoning Administrator must request that you remove the Shoney Boy from
your premises as such constitutes; where it has been placed, a freestanding
sign. Signs are defined pursuant to Sections 16-80 which states as follows:
Any display of any letters, words, numerals,
figures, devices, emblell;s, pictures, or any
part or combinations thereof, by any means
whereby the same are made visible for the
purpose of making anything known, whether such
display be made on, attached to, or as a part
of a structure, surface or any other thing, in-
cluding, but not limited to, the ground, any
rock, tree, or other natural object, which dis-
play is visible beyond the boundaries of the
parcel of land on which the same is made. A
display of less than one (1) square foot in
area is excluded from this definition.
Your variance was approved by the Board of Zoning Appeals to allow a
freestanding sign that exceeds the total aggregate area of the 100 feet
of two freestanding signs allowed on the same parcel in a B-1 zone. (See
Section 15A-6-1 of the Albemarle County Zoning Ordinance) Albemarle Square
has one freestanding sign and Shoney's has one freestanding sign whose area
was allowed by variance. Cedric's Fish and Chips was granted an additional
freestanding sign plus area by variance. Albemarle Square and Cedric' s have
complied with: the ordinance and the variance granted by the Board of Zoning
Appeals.
Therefore, your cooperation and understanding is requested in removing
the statue of the Shoney Boy by April 27, 1977 and not later than April 29th,
1977 in order that you meet the conditions of your variance and the zoning
ordinance.

Ruling :
The Albemarle Square Shopping Center is considered one
parcel of land and no more than two (2) freestanding
signs in the aggregate area of 100 square feet may exist
on such parcel . The major sign for the entire Square
will take 96 square feet leaving a residue of 4 square feet
The owners have not indicated that this remaining 4 square
feet shall be available to Shoney ' s . Being part of the same
parcel , Shoney ' s is thus not allowed to erect an additional
freestanding sign of the specifications which it has submitted .

Dear Mr. Jacobs,
Enclosed please find the application and other documents you will
need to seek a certificate of appropriateness for signage from
the Architectural Review Board (ARB) . Variance VA-76-17 allows
for a free-standing sign of 100 square feet on this site and
specifies the location of the sign; however, a new sign would
have to meet the current regulations for height (10 feet) and the
design guidelines for the entrance corridor adopted by the Board
of Supervisors.
I have enclosed a copy of these guidelines. While they relate
more to the design of the site and structures than signage, these
guidelines will give you an idea of what the ARB will require for
landscaping, lighting and other areas related to signage. If you
have any questions regarding the design guidelines or when the
ARB will hear your request, please call Marcia Joseph at 296-
5875. She is the Design Planner for the ARB.
Once you have received a certificate of appropriateness for the
signage, we will accept a sign application. The fee is $20;
after April 1, there will be a fee for ARB review ($60) and the
sign application fee will be $25.
