Dear Mr. Compton:
I am in receipt of your December 21st, 1976, letter concerning your re-
port that a Mr. M. Scovell Martin built a patio onto his house without a
building permit.
First, if the house does sit within the thirty foot (30') setback and
he built the patio after April of 1968, he would have had to cbtain a var-
iance to build anything within the then existing thirty foot (30' ) setback.
This requirement comes from the Albemarle County Zoning Ordinance and not
the Building Code. No one in either the Building Department or the Zoning
Department heard of the zoning violation until you' raised the issue. Whether
or not Mr. Martin, if he has violated the Zoning Ordinance, should now be re-
quited to obtain a variance is in my opinion a matter that I must discuss
with the County Attorney.
Regarding the issuance of a building permit, my office does not issue
building permits. The Zoning Administrator is required to review the zoning
before a building permit can be issued. The Building Official, Mr. Hartwell
Clarke, is responsible for the issuance of building permits. As to whether
or not Mr. Martin has violated the Building Code by building without a permit,
this must be determined by Mr. Clarke and not by the Zoning Administrator.

I shall engage a zoning inspector ;forthwith to review the site and •zon-
ing requirements before I consult with the County Attorney. I will forward
a copy of your letter with this letter to Mr. Hartwell Clarke, Building Offic-
ial. Any further correspondence as to the building of the patio without a per-
mit should be addressed to him.

(2) My visit to your office Friday,

(3) My letter to your office withdrawing
my request for variance, dated
November 11, 1976.
In all of the aforementinned references I reported to you that a direct
and deliberate violation of the Albemarle County Building Codes was made
by Mr M. Scovell Martin, an adjacent property owner of my property.
During my visit to your office you stated that you would have an inspector
look into the violation. To this date I have not had a response from your
office even after a written request of November 11, 1976.
The Violation made by Mr Martin consisted of building a concrete patio
onto an existing cottage which a remodling permit was graikted by your office
eventhoughthe cottage itself (prior to remodling was an old egg storage building
did not meet the 30' setback requirements. The fabrication of the cottage
from one of poultry use to one of rental income was done by a Mr. Clark Stearns
the previous owner approximately 4 years ago. Should you have any questions
as to the person or persons constructing the concrete patio onto the cottage
and violating the Building Codes, I recommend that you contact Mr. Stearns
at 804-823-5766. I shall even obtain the name of the person Mr Martin hired
to construct the patio if you desire.
I object to the patio because it is unsightly from my patio view and
secondly that Mr. Martin built the patio without a permit, and thirdly that
he is a conscientious objector to any and all neighbors seeking any variance
regardless how minute.
We neighbors of Mr. Martin would appreciate your attention to this

My wife and I are property-owners off Normandy Drive ,
near 1r. Compton' s property. We wish to state that we are
in agreement with the objectives of the designation of
Route 250 ,Vest as an Albemarle 6cenic Highway, and wish to
register our strong opposition to variances that allow homes
to be built closer to the road than the scenic ordinance
allows.
Because of our inability to attend the meeting of the
Board of Zoning Appeals on Tuesday, October 11, we request
that this letter be read to the Board on our behalf.

Dear Sir:
Our home is located on Normandy Drive, just off Route
2.50 west , and we are thus within the neighborhood of the
Compton property for which a variance has been requested
from the setback requirements of the scenic designation or-
dinance.
We have long supported the scenic designation of Route 250
west as a moans of preventing a repetition of Route 29 north
as Route 250 west develops. We oppose this variance as we are
concerned about our property value and that of other -neighbors
as well as on the attractiveness of Route 250 west .

Gentlemen:
My husband and I own property on 250 West and are concerned about requests
for variances in the requirement for setback of new structures.
This is one of Albemarle's few remaining easilt accessible areas which
offer the enjoyment of country quiet within a few miles of Charlottesville,
and we feel it is bound to grow as a desirable residential neighborhood if pro-
tected from further deterioration.
Traffic on 250 is heavy enough that a home without a protective setback is
exposed to 24-hour noise, and is questionable as a residence and as an investment.
That is why we were among the numerous property owners who $fined the petition to
make 250 a Scenic Highway and require a setback of 150 ft.
An undesirable site is the one thing about a home that cannot be improved
upon later. A site too close to highway noise automatically limits the desirability
of the property for its entire existence. So a setback is of dubious value to the
present owner and a possible trap for future purchasers, as well as an eventual
threat to property values in the vicinity, possibly even to ours.
We respect the required setback, and respectfully request you to protect
it on principle against property owners who are shortsighted enough to be willing
to disregard it.
If an individual case is such that you feel compelled to depart from the
requirement, you owe it to future residents and to neighboring property owners
to require a compensatory screening by trees and foliage to reduce the noise
nuisance as much as possible.
Thank you for considering this expression of our uneasiness about the pro-
tection of Route 250, which we have have come to iiimireand value highly.
