SUBJECT: Addition to 7-11 Store in Earlysville
DATE: November 30th, 1976
The attorney for Mr. Don King, Ralph Feil, and Frederick Payne, Deputy County
Attorney, met with the Zoning Administrator this date at 12:30 D.M.
The fact that Don King's appeal period, from the Board of Zoning Appeals ruling,
had run out (30 days from October 12th) was agreed to Mr. Feil stated that the
relationship between Mr. Winston Wood and Mr. Kina was one of landlord and ten-
ant. Mr. Wood had indicated he speaks for all of his family who signed the
lease with Mr. King.
Mr. Feil felt perhaps Don King'sapplication was a nullity since he was not fully
the owner who is supposed for the variance. This fact was considered to be very
possible. If it was or was not proper, Mr. King, if he can reach an accord with
Mr. Wood, may reapply with Mr. Wood being the applicant. Until such time this
becomes a reality (dependent on the success of negotiations) , the matter is dor-
mant.
However, as of the 23rd of December, 1976, the addition must come down unless
Mr. Wood makes application.
Mr. Feil said he might recommend that Mr. King go ahead and tear it down.

Dear Mr. King:
On the J2th day of October, the Board of Zoning Appeals denied your variance
to continue with an addition within the legal setback to the existing store. On
the 14th of October at 9:50 a.m. you spoke with the Zoning Administrator of the
possibility of having your lawyer contest the representations of Mr. Lawrence Wood
and to appeal the decision of the Board of Zoning Appeals.
The Zoning Ordinance allows for thirty (30) days to appeal the decision and
this has not been done. I did not hear from you or your attorney. The appeal
period expired thirty (30) days from October 12th, 1976.
It is therefore necessary that I request your addition to be removed within
thirty (30) days of the date of this letter.
If you have any questions, please contact the Zoning Administrator.

I would , however, like for ay views to ,e expressed at this
bearing.
The addition is first of all an eyesore . it destroys
the former sioule lines of the store and is shoddily
constructed .
Secundl y , it creates a traffic hazard . 'Aholesalers '
delivery trucks which frequently park on that side of
the store are forced by the addition to park so close
to the road that it seriously affects road visibility
for traffic entering =E:2, from 74� by the roadway
behind the store . I also wonder about the wisdom of
allowing e hi h concrete slac 14 feet from the ed`e of a
highway on the outside of a bad turn.
I hope the _Board of Lonin` i,bpeals will not allow
a variance that probably would never have been permitted
had t :e ap2lication proceeded the actual construction .
