Existing Activity
The property, at present, is vacant, however the owner plans to build
a single family dwelling on it. The property has only one level area
which is located in the front of the property. The flat portion of the
property runs approximately 60 feet (in length) to the woods line.
Proposed Variance
The applicant is requesting the Board grant a variance of 25 feet from
Section 3-3-1 of the Zoning Ordinance to allow dwelling to be located
in the setback, only 25 feet from the right-of-way, due to the topo-
graphy of the property.
Zoning Ordinance Requirements
The Zoning Ordinance reads as follows, Section 3-3-1,"Setback: the
minimum setback from any front yard shall be fifty (50) feet from the
front lot lines".
Staff Recommendation
The Staff feels that, depending on the size of the house, the house could
be so situated on the property to need only a twelve (12) foot variance.
This would allow for a 37 foot front setback and also allow for construction.
