Existing Activity
This site is located on the east side of Route 601, approximately 3/4 mile
south of its intersection with Route 671, midway between Free Union and
Boonesville. There are three (3) existing structures on the site used to
house some of the gas valves and equipment. Along the road there are two
rows of evergreen; the front row consists of white pines approximately 10'
to 14' in height, the back row consists of scotch pines of the same height
as the front. Towards the entrance the evergreens are only 3'-4' in height.
The buildings are newly painted and the entire site is well kept.
Proposed Variance
The applicant is requesting a variance of 45 feet from Section 2-3 of the
Albemarle County Zoning Ordinance (Setback in A-i Zone) to allow the build-
ing to be located 30 feet from the right-of-way of Route 601.
Zoning Ordinance Requirements
Section 2-3 of the Albemarle County Zoning Ordinance requires that "all
structures, as herein specifically defined, shall be located a minimum of
seventy-five (75) feet from any street, road, or access easement. For pur-
poses of this section only, the term "structure" shall not be deemed to in-
clude on-site signs for sale or rental of property, shelters designed and
used by school children traveling to and from school, or structures, other
than signs, for which no permit is required under the Uniform Statewide
Building Code".
Harship
Company regulations and Codes and land geographically prohibits a setback
of seventy-five feet.
Staff Recommendation
The largest building is located only 57 feet from the front property line and
26 feet from the rear property line; the other smaller buildings are both
located within the front setback lines. The staff feels that either a variance
must be granted to the rear or the front or prohibit the applicant from build-
ing on this site. This proposed buildina houses a flame which by State and Federal
codes cannot be but so may ft. close to the gas distribution lines. If approved we
suggests the following conditions:
1) Site plan be submitted, if necessary;
2) Building permits be obtained prior to construction.
