parcel, the only house site is as requested-.Health Department concurs
that this only acceptable house location for septic system and will issue
1 permit for this location only. Farmers Home Administration has ap
proved
housing loan based on building on this lot.

STAFF REPORT

Acreage: 2 acres of a 7.12 acre tract
Existing Activity
The two acre tract in question is vacant, fairly wooded, with two creeks
which seem to run through the middle of the property. From the edge of
the right-of-way of Route 635, the creek is located approximately 80 or
90 feet. There is a 50 foot right-of-way along Route 635; 25 feet from
the centerline of Route 635. The Health Department plans to make an
inspection of the site on December 10, 1976.
Proposed Variance
The applicant is requesting a variance of 45 feet from Section 2-3 of the
Albemarle County Zoning Ordinance to allow dwelling to be located 30 feet
from the right-of-way of Route 635.
Hardship
The applicant is requesting this variance because of the terrain of this two
acre parcel.
Zoning Ordinance Requirements
Section 2-3 of the Albemarle County Zoning Ordinance requires "all structures,
as herein specifically defined, shall be located a minimum of seventy-five
feet from any street, road, or access easement. For purposes of this section
only, the term "structures" shall not be deemed to include on-site signs for
sale or rental of property, shelters designed and used by school children
traveling to and from school, or structures, other than signs, for which no
permit is required under the Uniform Statewide Building Code".
Staff Recommendation
There seems to be two possibilities; the first being the possibility of placing
the house behind the creek (quite a few trees would have to be removed, access
would have to be created by placing a pipe across stream or a small bridge and
health department approval given) ; the second alternative would be to allow
variance from front setback. If approved we suggest the following conditions be
placed on the variance:
1) Plat be approved through the Planning Department;
2) Building permits be obtained from the Inspections Department; and
3) Health Department approval be obtained.
