STAFF REPORT
VA-76-43 Double C Corporation (Contract Purchaser)
Tax Map: 59B, Block B, Lot 5, Kearsarge Subdivision

Acreage: 1 acre
Existing Activity
The lot is of record as part of the Kearsarge Subdivision and is designated
as a building lot. The lot lies on the south side of Route 250 West and is
adjoined by other Kearsarge landowners. The lot has considerable trees and
foliage and the lot sits higher than the level of Route 250.
Proposed Variance
The applicant requests a variance from the A-1 Zone setback requirements of
75 feet and from the Scenic Highway setback requirements of 150 feet. The
front of the house will face a private right-of-way of Kearsarge and the rear
of the house shall face the scenic highway. The A-1 75 ft. applies to the
front and the scenic highway setback to the rear. (See submitted drawing. )
A 45 ft. variance is requested for the front of the house and a 50 ft.
variance is requested from the rear facing the scenic highway.
Zoning Ordinance Requirements
The A-1 zone setback requirement is pursuant to Section 2-3 of the Albemarle
County Zoning Ordinance which reads as follows, "all structures, as herein
specifically defined, shall be located a minimum of seventy-five (75) feet from
any street, road or access easement. For purposes of this section only, the
term "structures" shall not be deemed to include on-site signs for sale or rent-
al of property, shelters designed and used by school children traveling to and
fro.l. school, or structures, other than signs, for which no permit is required
under the Uniform Statewide Building Code".
Section 18-3-1 reads as follows, "No structure, except as hereinafter provided
in the case of certain signs, shall be constructed within 150 feet of the
right-of-way of any designated scenic highway or Virginia byway width of fifty
feet or more, nor within 175 feet of the right-of-way of any such highway or
byway having a right-of-way width of less than fifty (50) feet".
Staff Recommendation
If the Board wishes to grant this variance the staff recommends approval with
the following conditions:
1) Building permits are obtained, and
2) any other state or county requirements which are applicable.

Dear Mr. & Mrs. Wells, Mr. Carter:
The Zoning Administrator has made an inspection of the Route 250 West
scenic highway site pertaining to variance VA-76-43 and the condition of
screening.
Mr. Wells informed me of your settlement on the screening requirement
and the new trees have been planted. I feel the variance conditions have
been more than satisfied. I recommend a good seed should be put down to
get a stand of grass for soil erosion control. The recent rain should be
of considerable help to your efforts.
Your cooperativeness and attention to this matter is greatly appreciated.

Dear Mr. Carter, Mr. & Mrs . Wells :
I spoke with Mrs . Robert Wells , Jr. , who, with her husband
now occupy the home on the land for which the County granted
a variance to the Double C. Organization on January 11, 1977 .
I informed Mrs . Wells that I had previously written Mr.
Carter on July 8 , 1977 concerning the replacement of some dying
evergreen trees required as screening by the Board of Zoning
Appeals and that we had discussed the matter informally several
. times . I understand that the land title has exchanged hands, and
. there is some dispute over who will replace the dead trees .
A variance from the . zoning ordinance runs both with the
land and the owner of the land. Therefore , the screening
requirement is the ultimate responsibility of the landowner
who in this case is Mr. $ Mrs . Wells . I believe , however,
the Wells are more than willing to take on this responsibility,
but with Mr. Carter' s help and assistance . They are willing
to do certain things , such as planting , but within reasonable
terms. They would like to see Mr. Carter live up to his
agreement made with the Board of Zoning Appeals .
While the variance runs with the land and the Wells are
ultimately responsible for the conditions of the variance , the
obligation that Mr. Carter assumed when he applied and obtained
the variance is still his until satisfactorily completed unless
there has been a private legal agreement between Mr. Carter and
the new homeowners that replaces his obligation.

The Zoning Administrator has the obligation, in any
event, to enforce the variance and the conditions upon which
the variance is subject.

Mrs . Wells has suggested that Mr. Carter allocate enough funds
to them in order to purchase new trees to replace the dead ones
and that they will plant the new trees. I suggest that you meet
together and work a solution out that will satisfy each of you
and the County and so inform the Zoning Administrator.
If I can be of any assistance , please let me know. As
all of you know this is the best planting season for trees
but we do have rainfall and water shortage. Please take
this into consideration in working out an agreement between
you. I hope to hear from all of you not later than October
10 , 1977 .
