Existing Activity
There is an office building located on parcel 3, which is located at the
entrance to Ednam Forest on Ednam Drive at its intersection with Route 250
West. The existing structure is a two story building with parking facilities
on both the east and west sides of the building. The present building houses
an insurance agency in the basement level, travel and real estate agencies
on the main floor as well as the insurance agency is occupying the attic. Also,
some evergreens exist between the highway and the office building for the pur-
pose of some screening. (Evergreens are approximately three to a group, approx-
imately 20-30 feet apart. ) The building site sits about 14 feet below highway.
Proposed Variance and Zoning Ordinance Requirements
The applicant is requesting a variance of fet from Section 18-3-1 of the
Albemarle County Zoning Ordinance, Scenic Highway, to allow the proposed build-
ing to be 40 feet from the highway right-of-way of Route 250 West. Section 18-3-1
of the Zoning Ordinance reads as follows, "No structure, except as hereinafter
provided in the case of certain signs, shall be constructed within 150 feet of
the right-of-way of any designated scenic highway or Virginia byway having a
right-of-way width of fifty feet or more, nor within 175 feet of the right-of-way
of any such highway or byway having a right-of-way of less than fifty (50) feet".
Staff Recommendation
If the Board wishes to grant this variance the staff suggests that approval be
given subject to the following conditions:
1) Grading Permit be obtained for all grading in excess of 10,000 square
feet (to include new construction of building and parking areas) ;
2) Site Plan Approval;
3) Building, Plumbing, and Electrical permits be obtained and approved
prior to any construction;
XI) Fire Marshal's Approval, and;
5) Any other state or county requirements which are applicable.
l/ 6) The Board of Zoning Appeals may wish to review and/or revoke variance
number VA-76-23 which was approved on September 21, 1976.
