Existing Activity
This site is located on the south side of Route 250 West, 1 mile east of
Brownsville. The parcel in question is long and narrow with an existing
structure located in the front of the property (Gola's Restaurant) .
Proposed Variance
The applicant is requesting a variance of 115 feet from the required 150
foot setback under Article 18-3-1 of the Albemarle County Zoning Ordinance,
Scenic Highway Designation, to allow for an addition to the existing build-
ing.
Zoning Ordinance Requirements
Route 250 West has been designated as a County Scenic Highway and Section
18-3-1 of the Albemarle County Zoning Ordinance states that no structure
except as hereinafter provided in the case of certain signs, shall be con-
structed within 150 feet of the right-of-way of any designated scenic high-
way or Virginia byway having a right-of-way width of fifty feet or more,
nor within 175 feet of the right-of-way of any such highway or byway having
a right-of-way width of less than fifty (50) feet.
Staff Recommendations
The proposed addition will be in line with the existing structure. If the
Board of Zoning Appeals wishes to grant this variance we recommend approval
subject to all state and local requirements being met when applicable.

Thank you for your notice.
We certainly have no objection to the Boar 's granting a variance so
long as it is conditioned upon respecting the intent, of the scenic Highway
Designation Ordinance and providing screening of commercial parking and
premises with suitable greenery.
We feel that conscientious observance of this ordinance is essential so
that expansion of commercial property does not correspondingly debase the
value of residential properties in the vicinity, thus cancelling out any gain
in the county's tax base. Such attention to aesthetic considerations will also
sustain the growth of the commercial establishments themselves by preserving
the visual, attractiveness of the Scenic Highway which attracts potential cus-
tomers to the area.
