Existing_ Activity
Single family dwellings are located to the north, east and south of this
parcel and single family dwelling with an accessory nonconforming auto
repair shop is located approximately 200 yards to the west.
Proposed Variance
Applicant requests a variance of 25 feet from the required 75 foot setback
under section 2-3 of the Zoning Ordinance. Due to the size of the lot the
75 foot setback is impossible to meet.
Zoning Ordinance Requirements
Section 2-3 of the Zoning Ordinance requires that all structures shall
be located a minimum of 75 feet from any street, road, or access easement.
Staff Comiuent
The lot is a nonconforming lot under the zoning ordinance but
is a lot of record existing prior to zoning. It is therefore a
legal buildable lot with the only requirement being setbacks .
The applicant meets all setbacks except the front one which
considering the size of the lot , the variance requested is not
unreasonable. The house is built and was allowed to be erected
under a previous Zoning Administrator ruling that the applicant
qualified under the grandfather clause of section 2-3(2nd paragraph)
which alllows for "expansion, enlargement or extension" of an
existing structure within the 75 ' setback if such existed before
October 21 , 1976. Acknowledging confusion, the Zoning Administrator
requested the applicant to apply for a variance to erase any question
to the Zoning Administrator 's legal construction of section 2-3.
(A building did exist on the lot , but it was not a single family
dwelling, but rather a cinder-block fruit laboratory that is
abandoned. ) The staff recommend approval. If the Board chooses
to approve the variance, the staff recouuuend no conditions .

I hereby give John B. Moore permission to act as my agent in applying for
a variance in the set back requirements from 35' to 75' which was enacted
recently by Albemarle County. I am the lawful owner of 39/100 of an acre
of land zoned A-I fronting on State Route 691 - being further described as
shown on a plat of Hugh F. Simms & Son, C. L. Surveyors recorded in Deed Book
276 Page 135, Albemarle County, Virginia. Also, better known as Parcel 72A
on Page 55 of the Albemarle County Tax Map.
