We are building a Wilco gas station on U. S. 250, section 78 of the county tax map, lot #3, and we ask for a variance of ten feet, which means the edge of the canopy will be twenty feet from the property line, and the pump island will be thirty feet from the property line. We feel this will improve the use of this lot. Also, because of visibility, our canopy will not be seen by the motoring public. There are other stations within this area with canopies over pump islands that extend closer than the thirty feet. Our canopy is a free-standing structure, only for the purpose of protecting customers from rainy and hot weather. We are enclosing an engineer's plat showing the lot this variance is requested on. Tab Williams Certified Letter #639098 RE: VA-77-20 - Zoning Variance Dear Mr. Williams: • Please refer to my last letter dated April 28, 1977. In that letter I feel it was made clear which necessary requirements the County Attorney's Office felt you must have in order for you to comply with the Board of Zoning Appeals variance and conditions. It is a legal requirement that will approve or disapprove your variance. The responsibility for fulfilling the requirement is yours and your attorney and it would be improper for the County Attorney's Office to per- form that which you, as the applicant, agreed to perform. If you or your attorney have any questions on the form, please contact the County Attorney's Office at (804) 296-7138. Please send your draft agreement to them for their approval. The Zoning Administrator will revoke the variance if this requirement is not met before June 28, 1977, and in that event, the Planning Commission can not hear your site plan. Williams Oil Company Tax Map: 78 parcel 3 Acreage: Zone: B-1 Existing Activity Unimproved lot upon which a proposed gas station is being built. Proposed Variance A 10 foot variance to allow an overhead canopy to encroach on the setback. All other structures shall be 30 feet from the right of way. Ordinance Requirement No structure within 30 feet of the right of way in a B-1 zone shall be erected. (Section 7-3) Staff Comment Unless the applicant can show why he can not meet the setback requirement, the staff recommends disapproval of the variance.
