Dear Mr. Lambert:
Your letter of April 15, 1977 has been received and evaluated by the
Zoning Administrator.

It is the ruling of the Zoning Administrator that Mr. Gadient's store
qualifies under Article 10 Section 10-7-1 based on the calculations repre-
sented in your letter. Therefore a variance on the fifty foot rear setback
will not be required.
If you have any questions regarding this matter, please do not hesitate

Commercial Building
Dear Mr. Dick:
As the architect for the proposed reconstruction of Mr. Gadient's
food store just north of Scottsville on Virginia Route 20, I interpret
Section 10-7 of the Zoning Ordinance of the County of Albemarle, page
53, to indicate that reconstruction the fire damaged building as a non-
corforming use (in violation of the fifty foot rear yard setback required
adjacent to A-1 zoning) is within the law provided that:
1. The replacement cost is seventy-five, or less, percent
of the total replacement cost for such building
2. That such reconstruction shall commence within twelve
months and be completed within twenty-four months
from the date of such damage.
The damaged area which resulted from fire represents 78.3 percent
of the total building, with damaged limited to above grade construction.
The footings and foundations are structurally sound to receive recon-
struction. As the value of the footings and foundations is not less than
six percent of the total reconstruction cost, the replacement cost is
73.6 percent, or less, of the total replacement cost for the building.
Mr. Gadient is proceeding with plans to reconstruct a portion of the
damaged building within the required time allowances.
If you have questions or need of additional information, please

Existing Use: Retail Grocery Store
Existing Activity
The building, before destruction by fire was a retail grocery store. Stock
was that of most average food stores. Adjoining this structure is another
dealing in automotive supplies (Coiner Parts) . This being on the southern
portion of the property. Properties adjoining this parcel on the north
and south are also zoned B-1. A-1 property adjoins in the rear of the pro-
perty.
Proposed Variance
The applicant is requesting the Board waive Section 18-3-7(A) , Parking
Scenic Highway, to allow parking and accessability in front of the site.
VA-76-42 was granted by the Board on February 8, 1977, to allow the building
to be 35 feet from the front right-of-way of Route 20 South.
Zoning Ordinance Requirements
Section 18-3-7(A) of the Albemarle County Zoning Ordinance reads as follows,
"In order to permit adequate screening, no parking shall be allowed within
fifty feet of the right-of-way of any designated scenic highway or Virginia
byway on land zoned commercial".
Staff Comment
The applicant has obtained a previous variance from setback
requirements of the scenic highway. A parking setback is also
required of the scenic highway and staff erroredin not seeing
that the applicant also needs a variance from this requirement.
The staff recommends approval.
