EXISTING ACTIVITY
Applicant has a single family residence being built on the scenic highway,
The area is wooded.

Applicant request a 3 foot variance from the scenic highway setback requirement.
The applicant had the required distance of 150' marked for him by a zoning
inspector. The Zoning Inspector marked a tree and the tree was bulldozed
down during excavation. Applicant, as a result, was off 3 feet on setback.
The house is up and under roof.
ORDINANCE REQUIREMENT
The scenic highway section 18-3-1 requires a 150 foot front setback from
a scenic highway right of way.
STAFF COMMENTS
Staff recommedns approval with the condition of screening. Since this problem
arose, i.e. , citizens missing setbacks due to bad measurements or marking,
the Inspections Department Director of Inspections shall be requiring the
staking off houses with a zoning or building inspector so there is no mistake
on setback.
