EXISTING ACTIVITY
Request varaince of 45 ft. from Section 2-3 of Zoning Ordinance, Setback,
to allow single-family dwelling to be 30 ft from rt. 660.
ORDINANCE REQUIREMENT
All structures as herein specifically defined, shall be located a minimum
of seventy-five (75) feet from any street, road, or access easement. For
purposes of this section only, the term "structures" shall not be deemed
to include on-site signs for sale or rental of property, shelters designed
and used by school children travelling to and from school, or structures,
other than signs, for which no permit is required under the Uniform Statewide
Building Code.
STAFF COMMENT
The applicant is faced with general mitigating factors. He has a City
gas line from which he must setback on. The motatorium on the Rivanna
Reservoir and streams flowing directly into the Reservoir requires that
he locate his house and all activity related there to 200 feet from
the Reservoir or stream. The slope is gradual until the back side of lot
where it levels off. (See Contour maps marked in red) If the Board
chooses to approve the variance, the staff recommends the following
condition:
1) That the applicant obtain approval of the location of the house
with regards to the City gas line from the City of Charlottesville.
There is a forty (40) foot gas easement located on this property. 4,,d '
