SCALE: __-._-_____-____ FILLD E0O r t S / G G 4 —_-- FILE NO ._._---________ 'rrr 'rw►' STAFF REPORT VA-77-32 - Robert Archer TAX MAP: 102 Parcel 33B ACREAGE: 2.00 ZONE: A-1 EXISTING ACTIVITY Single-Family Dwelling PROPOSED VARIANCE Request a 7 ft. variance from Section 18-3-1, Scenic Highway, to allow dwelling to be 143 ft. from front right-of-way and 6 ft. variance from side setback (Section 2-5-1) to allow dwelling to be 19 ft. from side property line. ORDINANCE REQUIREMENT No structures except as hereinafter provided in the case of certain signs, shall be constructed within 150 feet of the right-of-way of any designated scenic highway or Virginia byway having a right-of-way width of fifty feet or more, nor within 175 feet of the right-of-way of any such highway or byway having a right-of-way width of less than fifty (50) feet. Yard Regulation: The minimum side yard for each main structure shall be twenty-five (25) feet or more. STAFF COMMENT The applicant proceeded in good faith by correctly measuring the setback on the Old Rt. 20 right-of-way of fifty feet. The State Highway Department, however, has now acquired an 80 foot right-of-way and the applicant is caught by a shortage of seven feet. The applicant also moved his house sideways due to a large rock being in the way of his foundation and he therefore requests a sideyard variance of 6 ft.
