Single-Family Dwelling on 2 acres (Subdivision of land is proposed)
PROPOSED VARIANCE
Request 6 ft. variance from Section 2-3 of Zoning Ordinance to allow
dwelling to be 70 feet. from right-of-way of rt. 829.
ORDINANCE REQUIREMENT
All structures, as herein specifically defined, shall be located a
minimum of seventy-five (75) feet from any street, road, or access
easement. For purposes of this section only, the term "structures"
shall not be deemed to include on-site signs for sale or rental of
property, shelters designed and used by school children travelling
to and from school, or structures, other than signs, for which no
permit is required under the Uniform Statewide Building Code.
STAFF COMMENT
The contractor tried to comply with the setback requirement but
discovered the topography favored a turn of the building in
such a manner that one corner of the building encroached on the
setback by 5 feet.
The house is under roof and constructed. If the Board chooses to
approve the variance, the staff recommend no conditions.
