Proposed Variance The applicant seeks to place a service device essential to their business operation in handling 1 ton C/2 cylinders and proposes the structure be 43 ft. 6 in. from the right-of-way which constitutes a 31 ft. 6 in. variance. The hardship claimed is the present location of the building, the fact the loading area is where it is, and that practically no other location would be as functional or as suitable as this one. Staff Comment The structure itself will be unobtrusive due to its relatively small size and lack of bulk. It the Board chooses to grant this variance, the staff recommends no conditions. Ordinance Requirements "All structures, as herein specifically defined, shall be located a minimum of seventy-five (75) feet from any street, road, or access easement. For purposes of any street, road, or access easement. For purposes of this section only, the term "structures" shall not be deemed to include on-site signs for sale or rental of property, shelters designed and used by school children travelling to and from school, or structures, other than signs, for which no permit is required under the Uniform Statewide Building Code. Any structure located in this district which was lawfully in existence prior to October 21, 1976, and which is nonconforming solely in that it is located within seventy-five (75) feet of any street, road, or access easement as here- inabove provided, may be expanded, enlarged or extended as if it were a con- forming structure; provided, however, that such expansion, enlargement or extension shall not extend beyond the present front building line." County of Albemarle Charlottesville, Va. 22901 Dear Mary Joy, Enclosed find five (5) copies of a sketch which shows that the monorail for the proposed building addition at the Crozet Water Plant is in violation of the Zoning Ordinance Setback requirements , Article 2 , paragraph 203 in that it extends out beyond the face of the original building. Therefore in accordance with Article 12 paragraph 12 . 1-4 Application for Variance, we respectfully ask that a variance be granted to allow the monorail to extend beyond the face of the original building. Please refer to the enclosed sketch for additional information. At this time we have already received a variance of the proposed addition to be shortened to twelve feet.
