RE: Kirtley Site Plan Question on Variance 77-46 Parking
Per 18-3-7(b) , Scenic Highway Route 250 West
DATE: February 15, 1978
Pursuant to the Planning Commission meeting of January 31, 1978, at
which time a question arose concerning VA-77-46 granted by the Board of
Zoning Appeals to Mr. Kirtley, July 12, 1977, the Zoning Administrator
has reviewed the matter, as requested, and reports his conclusion. The
application, the public hearing tape and the architect's plans were re-
viewed. The Zoning Administrator also spoke with the Board of Zoning
Appeals and they concur with the Zoning Administrator's research.
The records are clear that the Board of Zoning Appeals granted the
variance of parking to include the aisle for which Mr. Kirtley applied
for on June 17, 1977. (Application attached) The motion by Mr. Smith
was to approve the applied for variance. The variance application in-
cluded a 30 foot variance from the 50 foot setback requirement. It is
very clear that the Board did not choose to alter the variance application
as they did not choose to delete anything that the variance application
sought. Any person who was agrieved by the variance would have had to
appealed the same within 30 days of the approval.
The Board voted unanimously to grant the variance. It is true that
the Deputy County Attorney requested the Chairman of the Board to receive
his comments on the aisle space which the Board listened to but did not
comment on or adopt in their motion.
