ZONING ORDINANCE REQUIREMENT
Section 2-3 Setback Regulations: All structures, as herein specifically defined,
shall be located a minimum of seventy-five (75) feet from any street, road,
or access easement. For purposes of this section only, the term "structures"
shall not be deemed to include on-site signs for sale or rental of property,
shelters designed and used by school children travelling to and from school,
or structures, other than signs, for which no permit is required under the
Uniform Statewide Building Code.
VARIANCE REQUESTED
Applicant requests a variance of 27 ft. from Section 2-3 of the Zoning Ordinance,
front setback, to allow the porch to be 48 ft. from the right-of-way on
property located on the east side of Route 715 about 2 miles south of Rt. 6.
STAFF COMMENT
The house existed prior to the enactment of Section 2-3. The proposed
addition is not cured by that section's grandfather clause in that it
exceeds the existing front building line. Absent a showing by the applicant
of being able to locate the porch. other than in the front of the house,
the staff recommends approval.
If the Board chooses to approve the variance, the staff recommends no
conditions.
