EXISTING ACTIVITY
Vancant Land - Proposed Gas Station Site.
ZONING ORDINANCE REQUIREMENT
Section 7-3 Setback Regulations: All structures, except signs advertising
sale or rent of the property, shall be located thirty (30) feet or more
from any street right-of-way.
VARIANCE REQUESTED
Applicant requests a variance of 25 ft. from Section 7-3 of the Zoning
Ordinance, front setback, to locate a sign 5 ft. from the right-of-way
of Route 250 East.
STAFF COMMENT
The site has more than adequate sight distance for recognition of the
business by the public proceeding east or west on route 250 east and, in
the opinion of the staff, no land conditions or other conditions that
constitute grounds for a hardship or other criteria of Section 12.1-2.2
exist. (No topographic condition, no strict enforcement of ordinance
that would unreasonably restrict the use of the property and no evidence
to date that granting the variance will alleviate a clearly demonstrable
hardship approaching confiscation.) The applicant purchased the land in
good faith and should know or should have known the ordinance restrictions.
The 30 foot setback is not unreasonable. Therefore the staff recommends
denial.
If the Board should choose to approve the variance, the staff recommends
the following condition:
1) Removal of the sign to the required setback at the owner's expense
when and if the road is widened by the Highway Department.
