White Tax Map: 54 Parcel: 15 Acreage: 1.46 Zone: A-1 EXISTING ACTIVITY Single-family Dwelling ZONING ORDINANCE REQUIREMENT Section 2-3 Setback Regulations: Any structure located in this district which was lawfully in existence prior to October 21, 1976, and which is non-conforming solely in that it is located within seventy-five (75) feet of any street, road, or access easement as hereinabove provided, may be expanded, enlarged or extended as if it were a conforming structure; provided, however, that such expansion, enlargement or extension shall not extend beyond the present front building line. VARIANCE REQUESTED Applicant requests a 2 ft. 3 in. variance form Section 2-3 of the Zoning Ordinance, front setback, to allow addition to be 27 ft. 9 in. from right-of-way of Rt. 660. Property is located across from Brown's Store, on the east side of Rt. 690 at Newtown. The applicant's carport does not exceed the front building line and would appear to conform with the grandfather clause of Section 2-3. The lay of the road creates, for the carport, however, a closer location to the state road than the house which conforms to the old 30 foot setback. Applicant claims that strict enforcement of the ordinance would create a demonstrable hardship that was entirely unseen at the time of proposed construction. STAFF COMMENT This is an unusual situation, not forseen by the applicant, but nonetheless one that technically violates the legislative and legal intent of section 2-3 and must be cured by a variance. The staff recommends approval.
